Development of copyright protection of audiovisual works: copyright problems of film works

Abstract:

V současné době, kdy technický rozvoj přináší nové druhy a způsoby v oblasti tvorby a užívání autorských uměleckých děl, se stává problematika jejich autorskoprávní ochrany často diskutovanou otázkou. Přesto se domnívám, že povědomí laické veřejnosti je o této problematice stále takřka nulové. Jednou z oblastí, která je rozvojem digitálních technologií (v tomto případě zejména internetu, DVD, kabelových televizí apod.) ohrožena nejvíce, je audiovizuální tvorba. Z tohoto důvodu jsem se rozhodla zmapovat, jak jsou autorská práva audiovizuálních děl chráněna a jak se jejich ochrana historicky vyvíjela. Vzhledem k tomu, že audiovizuální tvorba je jako oblast autorské tvůrčí činnosti relativně mladá, bylo i její začleňování do předmětů ochrany autorského zákona pozvolné. První verze autorského zákona z roku 1895 nezakotvovala tento předmět činnosti vůbec, následující právní úpravy se touto otázkou začínaly zabývat až s rozvojem kinematografie (později audiovize jako celku). Zájem o ošetření autorskoprávních vztahů v této umělecké činnosti byl vzestupný, zásadní změny dotýkající se oblasti audiovize přinesly až úpravy autorského zákona, které vešly v platnost po změně politických poměrů v roce 1989. Cílem této práce však nebylo pouze zmapovat vývoj a systematiku právní úpravy autorského zákona v naší zemi, ale i poukázat na to, jak změny právních úprav autorského zákona mohou spolu se změnami politickými otázku autorských práv uměleckých děl zkomplikovat. Toto dokládám příkladem autorských práv ke starým filmům. Filmová výroba v naší zemi procházela v minulém století v závislosti na politických okolnostech různými obdobími – od podnikání soukromého, přes podnikání státní, zpět k podnikání soukromému. Filmová díla (a tedy i autorská práva k nim) byla v roce 1945 zestátněna. Po politickém převratu v roce 1989 bylo filmové podnikání opět zprivatizováno a tím i státní majetek v oblasti filmu (včetně autorských práv). Toto vše v kombinaci se změnami, které přinesla právní úprava autorského zákona z roku 2000, situaci okolo autorských práv ke starým českým filmům notně znepřehlednilo. Součástí práce je i malé srovnání s vývojem situace ve filmovém podnikání ve Slovenské republice. Práce se částečně zabývá i organizacemi činnými v oblasti kolektivní správy a ochrany autorských práv děl audiovizuální povahy.

Abstract:

At present, when the technical development brings new types and ways in the field of production, and use of works of art in copyright, problems of the copyright protection have become the matter under discussion. Nevertheless, I think that there is an almost complete lack of awareness of the issues involved with the lay public. One of the areas which is most endangered by the development of the digital technology (in this case especially the Internet, DVD, cable television, and the like) is the audiovisual production. For this reason, I decided to map out how the copyrights of audiovisual works are protected, and how their protection had historically developed. With regard to the fact that the audiovisual production is relatively young within the field of the author creative activities, its integration into the subject matter of the Copyright Act had been gradual. The first version of the Copyright Act of 1895 did not include this subject of the activity at all, the following legal regulations were concerned with the issue in question at the time of the development of cinematography (later, audio-vision as a whole). Interest in the modification of copyright relations in this artistic activity was on the increase, and regulations of the Copyright Act which came into operation after the change in the political situation in 1989 marked a turning point in the area of audio-vision. The aim of my dissertation was not only to map out the development and taxonomy of legal regulations of the Copyright Act in this country, but also to point out how the changes of legal regulations of the Copyright Act may along with political changes complicate the issue of the copyright of works of art. I can support it with the example of the copyright on old films. Film production in this country went through various periods in dependence on the political situation in the last century – from private enterprising through state enterprising, and back to private enterprising. Film works (and copyrights related to them) were transferred to state ownership in 1945. After the coup in 1989, the film enterprise was again privatized, which also concerned the national property in the film area (including copyrights). All that in combination with the changes which were brought about by legal regulations of the Copyright Act in 2000 has made the situation concerning the copyrights on old Czech films quite untransparent. In my dissertation I also make a comparison with the development of the situation in the film business in the Slovak republic. It also partly deals with organizations active in the area of collective administration and protection of copyrights of audiovisual works.
