Termination of the examination stage in criminal proceeding

Abstract:

Diplomová práce se věnuje stadiu prověřování v trestním řízení. Zevrubně jsou popsána jednotlivá stadia trestního řízení, přičemž hlavní důraz je kladen na přípravné řízení, resp. stadium prověřování. U tohoto stadia je vymezen účel, funkce a zásady trestního řízení v něm uplatňované a subjekty podílející se na jeho průběhu. Vymezeno je zahájení stadia prověřování a jeho průběh, resp. úkony prováděné subjekty trestního řízení. Samotné těžiště diplomové práce spočívá v analýze způsobů ukončení stadia prověřování v návaznosti na komparaci současné české právní úpravy se slovenskou právní úpravou a v komparaci současného trestního řádu s připravovaným novým trestním řádem. Výstupem je deliberace nad rekodifikací trestního řádu, potažmo připravovaného nového trestního řádu. V závěru diplomové práce jsou zodpovězeny hypotézy stanovené v úvodní části diplomové práce. Hypotézy se váží ke způsobu ukončení postupu podle § 158 odst. 1 trestního řádu a zhodnocení potřebnosti rekodifikace současných způsobů ukončení stadia prověřování.

Abstract:

The diploma thesis focuses on the verification stage of criminal proceedings. It provides a detailed description of the individual stages of criminal proceedings with a principal focus on pre-trial proceedings and the verification stage. The stage is discussed in terms of its purpose, function, the principles of criminal proceedings applied there to and the entities involved in its course. The thesis describes the initiation of the verification stage and its course or, to be specific, the acts performed by the entities involved in criminal proceeding. The focal point of the diploma thesis is analysis of the forms of concluding the verification stage following a comparison of the Czech and Slovak legal systems and a comparison of the current Criminal Code with the upcoming amendment thereto. The outcome is a deliberation on the recodification of the Criminal Code and the upcoming amendment. The conclusion evaluates the hypotheses put forward in the introduction to the diploma thesis. The hypotheses reflect the forms of concluding the procedure under Section 158 (1) of the Criminal Code and promote a debate about whether the current forms of concluding the verification stage need to be recodified.
