Rules of succession

Abstract:

The aim of our thesis is to theoretically define the rules of succession under the substantive and procedural rules. This means that the thesis introduces readers of all general and fundamental issues concerning the succession. In the substantive part, we started describing the problem of succession to the general terms and we went to a preview of the sources which govern the inheritance laws. In the first chapter we have analyzed in succession assumptions. Part of my work was the processing of entry and refusal of inheritance and disinheritance and protection of the lawful heir. We continued with the chapter entitled Law of succession, which is the title of succession along inheritances, wills. Chapter introduces the four groups of legal succession, under which is inherited by virtue of inheritance law. Bachelor thesis focuses on succession and wills of its forms and the establishment of essential procedural requirements and clarification of their parts. The final chapter brings us to the procedural aspects of inheritance law where the work provides a brief description of the various stages of succession

Abstract:

Cieľom našej bakalárskej práce je teoreticky vymedziť právnu úpravu dedenia podľa hmotnoprávnej a procesnoprávnej úpravy. To znamená, že bakalárska práca oboznamuje čitateľov z celou všeobecnou a základnou problematikou týkajúcou sa dedenia. V hmotnoprávnej časti sme začali opisom problematiky dedenia zo všeobecného pohľadu a prešli sme na ukážku prameňov ktoré upravujú dedičské právo. V prvej kapitole sme si rozobrali predpoklady dedenia. Súčasťou bakalárskej práci bolo aj spracovanie nadobudnutia a odmietnutia dedičstva ako aj vydedenia a ochrana oprávneného dediča. Pokračovali sme kapitolou s názvom dedenie zo zákona, ktorý je dedičským titulom popri dedeniu zo závetu. Kapitola oboznamuje zo štyrmi zákonnými skupinami dedičského práva, podľa ktorých sa dedí podľa dedičského titulu zákon. Bakalárska práca sa zaoberá problematikou dedenia zo závetu a jeho foriem zriadenia a podstatným náležitostiam a objasnenie ich častí. V záverečnej kapitole sa dostávame k procesnej stránke dedičského práva kde práca prináša stručný opis jednotlivých fáz dedičského konania.
