The Exclusion Clause under Article 1F of the Convention Relating to the Status of Refugees: Possibilities and Limits of its Application in relation to Terrorist Suspects

Abstract:

Práce se věnuje tématu vylučující klauzule definice uprchlíka dle čl. 1F Úmluvy o právním postavení uprchlíků ve vztahu k terorismu. Specificky je pak zaměřena na podmínky a limity výkladu a aplikace čl. 1Fb) Úmluvy vůči osobám podezřelým z terorismu. Dospívá k závěru, že v rozhodovací praxi soudů sledovaných smluvních států nedochází k extenzivnímu výkladu a aplikaci čl. 1Fb) Úmluvy vůči žadatelům podezřelým z terorismu. K vyloučení širšího okruhu osob, než odpovídá vylučující klauzuli dle čl. 1F Úmluvy, nicméně dochází na základě vnitrostátních právních úprav některých států.

Abstract:

The thesis deals with the exclusion clause of the refugee definition under Article 1F of the Convention relating to the Status of Refugees and terrorism. Specifically, it explores the conditions and limits of interpretation and application of Article 1Fb) of the Convention in relation to terrorist suspects. It concludes that the top courts of the parties to the Convention do not resort to extensive interpretation of the exclusion provision in these cases. However, the extensive exclusion practice stems from national legislation which goes beyond the wording and scope of Article 1F.
