Reference for Preliminary Ruling

Abstract:

The objective of Bachelor‘s thesis is to evaluate the importance of preliminary ruling for the development of European law ass well as the work of domestic courts. At the beginning of the thesis general characteristics of the preliminary ruling is made. It emphasizes the importance of this institute and analyses article a preliminary ruling is based on. Next part aims to situations when it is not necessary to make a reference to the Court of Justice and its consequences. Relation between national courts and the reference for preliminary ruling in general and situation in Czech republic speifically is described in the last part of the thesis.

Abstract:

Predmetom bakalárskej práce je zhodnotiť význam predbežnej otázky pre vývoj európskeho práva ako aj pre prácu vnútroštátnych súdov. Práca začína všeobecnou charakteristikou konania o predbežnej otázke. Zdôrazňuje význam tohto inštitútu a zahŕňa v sebe rozbor článku, na ktorom prejudiciálne konanie stojí. V ďalšej časti sa bližšie zameriava na situácie kedy nie je potrebné zahájiť predbežné konanie pred Súdnym dvorom a ich následky. Posledná časť pojednáva všeobecne o národných súdoch a ich vzťahu k prejudiciálnej otázke a tiež konkrétne o situácii v Českej republike.
