Possession, ownership, legal institutions for their protection in Roman law and their reflection in Czech legal regulation

Abstract:

První z kapitol práce je věnována popisu držby a vlastnictví v římském právu. Aby bylo vůbec možno podat popis možností ochrany postavení držitele a vlastníka, je třeba nejdříve vyložit podstatu práv s držbou či vlastnictvím spojených. V části práce věnované římskoprávní držbě nejprve vykresluji náležitosti jejího nabytí a ztráty, dále reflektuji měnící se pohledy na tento právní institut v rámci dějinného vývoje římského práva. Zásadní význam pro následující výklad o typech vlastnictví má provedení problematikou nabývání vlastnického práva v římském právu, přičemž důraz je kladen na popis institutů MANCIPATIO, IN IURE CESSIO a TRADITIO. Za stěžejní pro tu následující část práce, která se věnuje ochraně držby, je nutno označit podrobný rozbor právního institutu vydržení včetně jeho podstatných náležitostí. Římské právo v kontrastu k dnešnímu disponovalo několika druhy vlastnického práva, ve své práci popisuji vlastnictví kviritské, bonitární, provinční a vlastnictví peregrínů. Následuje zásadní část práce věnovaná římskoprávní ochraně postavení držitele a vlastníka, přičemž v této souvislosti není možno nezmínit úlohu praetora při jejich utváření. Ochrana držitele cestou tzv. interdikt byla v římském právu velmi rozvinutá. Těžiště části práce věnované jednotlivým institutům ochrany vlastnictví a držby však spočívá v popisu žalob, které mohl držitel či vlastník uplatnit. Na tomto místě své práce důrazně poukazuji na skutečnost, že je zde velký rozdíl mezi římskoprávní ACTIO a dnešní žalobou. Nejsilnější žalobou, kterou disponoval vlastník, byla v římském právu reivindikace, žaloba na vydání věci. Následně se vyvinula celá skupina žalob reivindikaci podobných, teorií nazývaných souhrně REIVINDICATIO UTILES. Jednalo se o procesní prostředky umožňující žalobci silnějšího postavení než při reivindikaci, ovšem za podmínek odlišných. Zatímco reivindikace směřovala na vydání věci, další kategorie žalob byla určena k odstranění rušení vlastnického práva zásahy menší intenzity, jednalo se o tzv. negatorní žaloby. Mimo to upravovalo římské právo řadu dalších žalobních typů, určených pro poměrně specifické situace. Sem patřila např. žaloba mezní, směřující k určení hranic pozemku. Velmi významným žalobním typem, který byl v římském právu upraven a který obsahují právní řády dodnes, byla žaloba z lepšího práva, žaloba publiciánská – ACTIO PUBLICIANA IN REM. K ochraně svého majetku mohl vlastník použít také žalobu na vydání bezdůvodného obohacení – CONDICTIO. Část práce věnovaná současné právní úpravě řeší zprvu postavení držitele a vlastníka v platném českém právu. Nejprve jsou zkoumány její římskoprávní kořeny, následně je popsána v současnosti platná a účinná úprava. V této souvislosti je velká pozornost věnována institutu držby, především z hlediska její oprávněnosti, přičemž k tomuto tématu existuje obsáhlá judikatura. Nelze pominout ani problematiku vydržení, která s držbou bezprostředně souvisí. Postavení držitele je i dnes, analogicky k právu římskému, chráněno mimo jiné posesorními ochrannými prostředky a publiciánskou žalobou. Následně se zabývám platnou úpravou institutu vlastnického práva. Lze konstatovat, že i ochrana, kterou platný právní řád přiznává vlastníkovi, ve velkém rozsahu pochází z římského práva. Krátce se věnuji také problematice imisí, úpravě žaloby reivindikační a negatorní, dále žalobě na vydání bezdůvodného obohacení. Poslední část práce věnuji úpravě vlastnictví, držby a institutů jejich ochrany v novém občanském zákoníku. Nejprve se zabývám problematikou držby,

zmíním nové vymezení držby jako pravé, poctivé a řádné. Následně provedu výklad problematiky vydržení v nové úpravě, přiblížím pohled na vlastnické právo a jeho úpravu. Provedu výklad o ochraně vlastníka, žalobách, které mu příslušejí a jeho nárocích. Závěrem práce jsou shrnuty dosavadní poznatky a zdůrazněn význam římského práva pro platnou i budoucí právní úpravu držby, vlastnictví a jejich ochrany v českém právu. Za významnou součást římskoprávní regulace považuji vztah k AEQUITAS, stálou snahu o nalezení vždy spravedlivého řešení sporu a minimální teoretizování. Jsem přesvědčena, že římské právo bude navždy zdrojem inspirace pro tvorbu i aplikaci současného práva. Závěrem konstatuji, že nová občanskoprávní úprava institutů vlastnického práva a vydržení je významným krokem ke zdokonalení českého právního řádu, který nepochybně čerpá z římskoprávních kořenů.

Abstract:

The thesis entitled “Possession, ownership, legal institutions for their protection in Roman law and their reflection in Czech legal regulation” aims at introducing the subject matter, and describing the relevant legal institutions, their development and changes in application. The introduction of the work deals with the significance of the legal institution of the ownership and possession rights for life of the society and the need for their most perfect legal definition and protection. This is a universally valid requirement existing since the Roman law period. The specific feature of working with Roman legal sources is the difference between the current and historical perception of legal institutions, and significant fragmentation of written sources, which makes work more difficult for Romance scholars. Therefore, it is sometimes impossible to fully understand the intention of an ancient legislator. The first chapter is devoted to the detailed analysis of the issues of possession and ownership in Roman law. In order to provide a comprehensive description of possibilities of the possessor’s and owner’s protection, we must first explain the nature of rights related to possession and ownership. In the part of the work dealing with possession under Roman law, the requisites of its acquisition and loss are described, and the changing views of this institution within the framework of the historical development of Roman law are reflected. In order to impeccably describe the Roman understanding of ownership it is vital to briefly introduce the issues of objects in legal sense. One of the biggest differences between Roman and modern law consists in the range of subjects that could be considered as the owner. For the subsequent exposition of the types of ownership it is important to guide the reader through the issues of acquisition of ownership right in Roman law, while the description of the institutions of MANCIPATIO, IN IURE CESSIO and TRADITIO is crucial. For the next part of the thesis, dealing with the protection of possession, a detailed analysis of the legal institution of usucaption – USUCAPIO – including its requisites is essential. Contrary to the current law, Roman law used several types of ownership rights; in this work I describe the quiritarian ownership – DOMINIUM EX JURE QUIRITUM, bonitary, provincial ownership and ownership by foreigners (PEREGRINI). The subsequent part of the work is fundamental and is devoted to the protection of the positions of possessor and owner. In this context the role of praetor in their formation must be mentioned. Roman law had an advanced conception of possessor’s protection through the so-called interdictums (possessory protection). The core of the section devoted to the respective institutions of ownership and possession protection lies in the description of actions that the possessor or the owner could assert. At this point of the work I strongly point out to the fact that there is a big difference between the Roman law ACTIO and today’s action. Roman law was a system of actions, and each rightfully asserted claim had a corresponding action. Modern law, on the contrary, clearly separates substantial and procedural law, considering the action as an institution in the domain of purely procedural law. The most powerful type of action available to the owner under Roman law was an action claiming the return of a thing – REI VINDICATIO. Subsequently, a number of actions similar to REI VINDICATIO developed, in theory referred to collectively as REIVINDICATIONES UTILES. These were procedural means enabling the plaintiff a strong position such as with REI VINDICATIO, but under different circumstances, especially if the plaintiff was not the owner of the thing. Whereas REI VINDICATIO aimed at the return of a thing, another category of actions intended to remedy infringement of ownership right by interventions of lesser intensity; these were the so-called negatory actions. n addition, Roman law regulated a range of other types of action, designed for rather specific situation; as an example we can name the legal action for the determination of boundaries of a land. One of significant types of action, regulated by Roman law and surviving in legal systems until today, was an action under “better law” – ACTIO PUBLICIANA IN REM. This legal institution is first described, examples of its application are listed and its significance and theories of its origin are dealt with. A very specific and theoretically frequently examined issue is the use of ACTIO PUBLICIANA IN REM in case of a transfer of ownership right by a non-owner. The owner could also use the action for the release of unjust enrichment – CONDICTIO – in order to protect his property. The part of the thesis on current legal regulation introduces the positions of possessor and owner under the applicable Czech laws. Their Roman law origins are surveyed, and their present valid and effective regulation is described. In this context, attention is paid to the institution of possession mainly in view of its legitimacy, and the rich judicial decisions concerning this topic are mentioned. Immediately related to the possession are the issues of usucaption, which must not be omitted. Accordingly to Roman law, the position of the possessor is nowadays protected by possessory means and by ACTIO PUBLICIANA IN REM. In the next part the regulation of the institution of ownership right is pondered. It may be established that the protection assigned to the owner by the current laws largely dates back to Roman law. Issues of immission, regulation of the reivindication and negatory action and action for the release of unjust enrichment are discussed briefly. The last part of the work is devoted to the regulation of ownership, possession and institutions of their protection in the new Civil Code. Issues of possession are discussed and the new definition of possession as true, fair and proper is mentioned. The new regulation of usucaption and ownership right is explained, followed by exposition of the protection of the owner, his claims and available actions. In conclusion, the hitherto findings are summarized and importance of Roman law for the existing and future legal regulation of possession, ownership and their protection in Czech laws is accentuated. In my opinion, an important concept of Roman law regulation is the attitude toward AEQUITAS, an unceasing effort to arrive at the fair resolution of a dispute with the minimum of theorizing. It is my conviction that Roman law will always remain a source of inspiration in the process of creation and application of contemporary law. It may be concluded that the new civil law regulation of institutions of ownership and usucaption is an important contribution to the perfection of Czech legal system, which has undoubtedly been inspired by its Roman origins.
