Imposing fines according to Act on Transgressions

Abstract:

Pro téma bakalářské práce jsem si vybral ukládání sankcí v přestupkovém řízení. Toto téma je mi blízké, protože se s přestupkovým řízením ve své profesi setkávám prakticky každý den. Pracuji jako policejní inspektor dopravních nehod, takže ukládání sankcí v přestupkovém řízení je z části také náplní mé práce. V úvodní části bakalářské práce vymezuji samotný pojem přestupek, jednání, které má znaky přestupku, ale přestupkem není, a dále hranice mezi přestupkem a trestným činem, či správním deliktem. V neposlední řadě také definuji míru zavinění, věkovou hranici a příčetnost pachatele přestupku. Dále vymezuji obecně jednotlivé sankce přestupkového řízení dle ustanovení § 11 zákona č. 200/1990 Sb. o přestupcích. Věnuji se ukládání sankcí za dopravní přestupky, ukazuji, které sankce lze použít při řešení dopravních přestupků. Nejvíce používanou sankcí při řešení dopravních přestupků je pokuta. Ve své práci uvádím, jaké maximální pokuty lze ukládat, jak ve správním, příkazním, či blokovém řízení, a jakou lze uložit sankci za konkrétní přestupek v dopravě. Po vymezení druhů sankcí uvádím samotný proces ukládání sankcí za dopravní přestupky, zejména v blokovém řízení, kde se například zabývám doporučeným sazebníkem pokut za přestupky v dopravě. Vysvětluji, jak lze projednat přestupek a také, jak řešit dopravní nehody v blokovém řízení. Uvádím formu zkráceného řízení o přestupku, kterým je příkazní řízení, kde ukazuji, jak se používá při řešení dopravních přestupků. Stručně také objasňuji pojem řádný opravný prostředek, který lze použít v příkazním řízení, to je odpor. Z hlediska procedurálního je nejsložitější formou ukládání sankcí v přestupkovém řízení správní řízení, které je upraveno ve správním řádu. V další části se zabývám ukládáním sankcí za přestupky proti bezpečnosti a plynulosti provozu. Jedná se o § 22 odst. 1. písm. c), e), f) a s ním související novelizace, která bude platit od 1.7.2006. V úplném závěru věnuji pozornost přezkoumávání rozhodnutí správních orgánů soudem. Jsem rád, že jsem měl možnost si vybrat jako téma bakalářské práce právě ukládání sankcí v přestupkovém řízení, které je mé profesi velmi blízké. Měl jsem možnost se seznámit i s dalšími složitějšími procesy ukládání sankcí, jako jsou příkazní a správní řízení. Myslím si, že by se měl samotný proces ukládání sankcí zjednodušit, aby byl pružnější, a tím i účinnější. Stav na našich silnicích je ve srovnání se státy EU katastrofický a je jasné, že ho může vyřešit jen hlubší změna systému, která se projeví až za nějaký čas.

Abstract:

The subject matter of my Bachelors thesis is the imposition of sanctions within administrative offence proceedings. I am interested in this subject matter, since I deal with these issues on a day-to-day basis. More specifically, I am employed as a police inspector of traffic accidents and imposing sanctions is therefore part of my job. The introductory section of this Bachelors thesis defines the concept of an administrative offence, defines conduct having features of an administrative offence but not qualifying as such, and distinguishes between an administrative offence and a criminal offence or administrative delict, respectively. Last but not least, the degree of fault, the age limit and the sanity of an offender are defined. Individual sanctions of the administrative offence proceedings under Article 11 of Act No. 200/1990 Coll., on administrative offences are defined in a general. The imposition of sanctions for traffic offences are further considered, indicating which sanctions may be imposed in the context of traffic offences. The sanction most often used when dealing with traffic offences are fines. The thesis sets out which maximum fines may be imposed, be it in an administrative proceeding, in a procedure to issue an administrative order, or in an administrative hearing on a ticket, and which sanctions may be imposed for a particular traffic offence. Having defined the types of sanctions, the actual process of imposing sanctions for traffic offences is discussed, particularly in the context of an administrative hearing on a ticket, considering for example, the recommended fine tariff for traffic offences. The procedures for hearing administrative offences and dealing with traffic accidents within an administrative hearing on a ticket are explained. The simplified administrative offence proceeding, namely the procedure to issue an administrative order is discussed, explaining how this type of procedure is applied in the context of dealing with traffic offences. In addition, the standard remedial measure that can be invoked in the procedure to issue an administrative order, i.e. protest is briefly clarified. From a procedural perspective, the most complex form of the imposition of sanctions in administrative offence proceedings is the administrative proceeding which is governed by the Administrative Proceeding Act. The following section covers the imposition of sanctions for administrative offences against safety and fluidity of traffic. This concerns Article 22 (1)(c), (e) and (f) and the related amendment which will come into force on 1.7.2006. The final section deals with a review of the administrative authorities decisions by the courts. I am glad to have had the opportunity to choose the subject of the imposition of sanctions in administrative offence proceedings for my Bachelors thesis, which is an intrinsic aspect of my work. I thereby acquainted myself also with other more complex procedures of imposing sanctions such as the procedure to issue an administrative order and the administrative proceeding. I am of the opinion that the process of imposing sanctions should be simplified in order to make it more flexible and thus, more effective. The situation on our roads, in comparison to other EU states, is disastrous and it is clear that it can only be improved by a more profound systemic change, the impact of which will become apparent only after some time.
