The Rights and Duties of Arbitrators with Respect to the Parties of the Dispute

Abstract:

Diplomová práce představuje obsah právního vztahu mezi rozhodcem a stranami rozhodčí smlouvy v praxi mezinárodní obchodní arbitráže. Tento vztah vykazuje řadu specifik, jež jsou důsledkem kolize mezi pozitivním právem a principy imanentními rozhodčímu řízení. Autor se snaží obeznámit čtenáře zejména s dílčími povinnostmi rozhodce a následky jejich porušení. Zdůrazňuje, že podoba příslušné dílčí povinnosti nevychází z automatické aplikace relevantních norem, ale z proporcionálního posuzování práv a oprávněných zájmů účastníků rozhodčího řízení. Pokud si rozhodčí řízení má zachovat původní smysl, tj. ekonomičnost a flexibilitu, není vhodné upravovat detaily statusu rozhodce vůlí zákonodárce. Vzájemnému vztahu naopak prospívá svoboda rozhodce a diskrece v rámci rozhodování o procesních otázkách.

Abstract:

The diploma thesis explains the aspects of legal relationship between an arbitrator and parties to arbitration agreement in the perspective of international commercial arbitration. Such relationship shows specific features as a result of collision between written law and the principles of arbitration. The author attempts to figure out and describe the specific duties of arbitrators and consequences of their breach. It is emphasized that exercising of each duty is not mechanical but is rather based on proportional comparison of rights and interests of the parties to arbitration. In order for arbitration to maintain its original purpose, i.e. low-cost and flexibility, it is not appropriate to regulate every detail of arbitrator’s status by statutory law. On the other hand, arbitration benefits from the freedom of arbitrators and their discretion to determine procedural conduct.
