The Law and the Internet

Abstract:

Diplomová práce se zabývá vztahem dvou aktuálních fenoménů moderní doby - internetu a práva. Práce je rozdělena do tří částí - v první je podána stručná charakteristika internetu, druhá se věnuje zejména přehledu relevantních právních i neprávních pramenů (zastoupených internetovou etikou). Ve třetím oddílu je podrobněji popsán mechanismus uplatňování jurisdikce v prostředí internetu a zohledněna relevantní judikatura, včetně rozboru Nařízení Rady č. 44/2001 o příslušnosti a uznávání a výkonu soudních rozhodnutí v občanských a obchodních věcech.

Abstract:

This diploma thesis gives a brief description of relation between todays most important world phenomenons – the law and the Internet. It is divided into three main chapters. The first is trying to understand the Internet in the technical point of view and in the view of lawyers. The second chapter goes more into a legal aspect with an attempt to constitute “Internet law” as a delimited law sub-branch of the law of information and communication technology (ICT law) and continues fluently to depiction of key legal sources of Czech internet law – the main emphasis is given to the international and community regulations, regarding criminal and private law. The last part deals with the efforts to find an effective rule that would let us transparently and easily delimitate courts' jurisdiction in public and primarily private international legal relations including in depth analysis of some of the important cases, mainly U.S. The general overview of European “Council Regulation No 44/2001 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters” is also present.
