Reconciliation of the Parties of the Dispute During the Civil Proceeding

Abstract:

Práce je věnována tématu usmiřování stran sporu v průběhu civilního soudního řízení. Usmiřování stran sporu v průběhu civilního soudního řízení je úzce spojeno s procesní aktivitou soudce. K procesní aktivitě soudce v průběhu řízení se nicméně koncep-ce věnující se civilnímu procesu staví odlišně. V souvislosti s tím se práce zaměřuje v úvodní části na koncepce civilního procesu, následně je provedena analýza předního tuzemského procesního předpisu za účelem představení procesních nástrojů užívaných soudcem za účelem usmíření stran. V závěru práce je věnován prostor koncepci anglosaského původu Multi-door courthouse, a následně i institutu smírčích soudců, který se těší zejména v Německu velké oblibě, a mohl by pro tuzemského zákonodárce býti inspirativní.

Abstract:

This diploma thesis is dedicated to the topic of reconciliation of the parties during the civil proceeding. The reconciliation of parties during the civil court proceeding is tightly connected with the process activity of the judge. Diploma thesis is dealing at the very beginning with the con-cepts of the civil procedure, then the analysis of the main domestic procedural regulation is done, for the purpose of reconciliation of parties. The final part of thesis is dedicated to the anglosaxon concept Multi-door courthouse, and then the institute of Guterichter, which especially in Germany enjoys its popularity, and could be an inspiration for the domestic legislator.
