Abstract:

Diplomová práce na téma Rating v českém a evropském právu se opírá o nařízení Evropského parlamentu a Rady (ES) č. 1060/2009 a adaptaci tohoto nařízení do českého právního řádu. V úvodu práce je pojem rating vymezen z ekonomického hlediska a je nastíněna problematika financování ratingových agentur a jejich spojitost s ekonomickou krizí. Stěžejní částí práce je pak rozbor nařízení a promítnutí nařízení do české právní úpravy. Zajímavou částí práce z hlediska aplikačního je současná praxe z pohledu České národní banky, ratingových agentur a investorů. Práce předkládá pohled na rating jako jeden z regulačních nástrojů.

Abstract:

The importance of rating and rating agencies has increased rapidly during the recent years. The presented diploma thesis outlines the basic information about rating as an economic instrument of investors and provides the reader with a short insight into the history of the rating agencies on the background of the currently well-known global economic crisis. An analysis of the credit rating agencies regulation is the main part of the presented thesis as well as adapting the Regulation into the Czech legal order. The author points out some particularly problematic areas which were not dealt with successfully by the Czech legislature. The last part shows practical application problems from the point of view of the credit rating agencies, investors and Czech National Bank.
