Subordinate Clauses in the Testament

Abstract:

Diplomová práce pojednává o vedlejších doložkách v závěti, které se do českého právního řádu navrací po více než šedesáti letech. Cílem práce je provést komplexní analýzu vedlejších doložek v závěti s použitím relevantní literatury a judikatury. V práci jsou osvětleny římskoprávní kořeny tohoto právního jednání, dále je zmapován historický vývoj v právních řádech platných na našem území. Pozornost je věnována úpravě vedlejších doložek v zákoně č. 89/2012 Sb. a souvisejícím institutům. Součástí diplomové práce je také exkurz do právní úpravy vedlejších doložek v Německu.

Abstract:

The diploma thesis deals with the subordinate clauses in the testament, which returns in the Czech legal system after more than sixty years. The aim of the thesis is to conduct a comprehensive analysis of the subordinate clauses in the testament using relevant literature and case law. In the thesis are explained the Roman law roots of this legal act, then there is described the historical development of the law in our country. Attention is paid to the subordinate clauses in the Act No 89/2012 and related institutes. The part of the thesis is also excursion into the regulation of the subordinate clauses in Germany.
