The legal regime of land intended to fulfill the functions of the forest

Abstract:

Předkládaná práce pojednává o právním režimu pozemků určených k plnění funkcí lesa. Nejprve pojednává o platné legislativě v této oblasti, přičemž základ kapitoly tvoří zákon č. 285/1995 Sb. o lesích, tzv. lesní zákon, jehož struktura je blíže představena. Jsou také uvedeny některé prováděcí předpisy k tomuto zákonu a další zákony, které s lesním zákonem souvisejí a mají vliv na pozemky určené k plnění funkcí lesa. Následně práce vysvětluje základní právní pojmy a zmiňuje se též o kategorizaci lesů. Hlavní část práce tvoří kapitola 3, která se zabývá právním režimem pozemků určených k plnění funkcí lesa, přičemž značná část této kapitoly je věnována výkladu o orgánech státní správy lesů a jejich pravomocech a povinnostech. Následně se práce zabývá ochranou lesních pozemků. Zmíněny jsou základní principy ochrany. Práce nezapomíná ani na roli českého státu ve vztahu k pozemkům určeným k plnění funkcí lesa, neboť značná část těchto nemovitostí je vlastněna státem. Zmíněno je také obecné užívání lesů a některé zakázané činnosti. Poslední kapitola pojednává o evidenci ve vztahu k pozemkům určeným k plnění funkcí lesa a ke katastru nemovitostí. Vlastnické vztahy v rámci těchto pozemků jsou zmiňovány v práci průběžně, stejně jako problematika dělení pozemků a odnímání či omezování jejich funkci. V závěru je zhodnocena platná právní úprava včetně možných návrhů na změnu.

Abstract:

This current work deals with the legal regime of the land intended to fulfill the functions of the forest. First, it shows the current basic law with the emphasis on the elementary individual act in this area – the so called Forest Law. The structure of the act is introduced together with some of the executive regulations as issued by the government of the Czech Republic and individual ministries. Another corresponding laws are discussed consequently. After that the work speaks about the basic legal terms necessary to understand in the context of this work. It also discusses the categories of forests as they are implemented into the Czech policies. The main emphasis of the work lies in the third chapter which deals with the issues connected to the land intended to fulfill the functions of the forest. A large part of this chapter is devoted to the introduction of the individual levels of forest administration and their responsibilities and authority in relation to the forest land. Another major part of the work discusses the various ways of protection of the land intended to fulfill the functions of the forest. Also the elementary principles of the protection are mentioned. The work does not forget even the role of the Czech state connected with this land since a big part of the forest land is owned by the state. Some notes are made about the general usage of the forest by public and some activities which are forbidden in connection with the forest land are stated. The last chapter talks about the ways of record keeping connected with the forest land and with the land register. The owners' relations are discussed throughout the text together with the issues of division of the land or possible changes in its function. In the conclusion the possible future changes of the current law are discussed.
