The Doctrine of the Constitutional Court in relation to the European Law

Abstract:

Cílem této práce je komplexní analýza judikatury Ústavního soudu, která se zabývá vlastnostmi evropského práva, jeho působením na vnitrostátní právo a jejich vzájemným vztahem. V práci se nejprve se zabýváme výkladem používaných pojmů a definujeme nejdůležitější principy evropského práva a jeho působení na území členských států tak, jak je ve své judikatuře zformuloval Soudní dvůr Evropské unie. Jako pomyslnou druhou dimenzi vztahu práva evropského s právem národním stručně rozebíráme přístup vybraných národních soudních institucí, oprávněných k závaznému výkladu těchto otázek. Stěžejní je pro nás přístup Ústavního soudu ČR k otázkám evropského práva, jejichž zodpovězení se od něj po vstupu ČR do EU očekávalo. Postupně jsou rozebírány otázky zakotvení evropského práva v českém právním řádu, otázka účinků evropského práva uvnitř českého právního řádu a limitů, které vůči nim Ústavní soud vytváří, otázka zda se kvantitativně či kvalitativně změnil ústavní pořádek vstupem ČR do EU, otázka přístupu Ústavního soudu k institutu předběžné otázky v evropském právu a otázka posunu v chápání pojmu státní suverenity. Z materiálního i formálního hlediska rozebíráme také první případy předběžné kontroly ústavnosti mezinárodních smluv, které náš ÚS řešil ve věci Lisabonské smlouvy. Zabýváme se velmi překvapujícím nálezem ÚS z poslední doby. Závěrem shrnujeme určité obecné principy týkající se vztahu ústavního a evropského práva, které lze z judikatury Ústavního soudu dovodit.

Abstract:

The topic of this Master?s Thesis is ?The Doctrine of the Constitutional Court in relation to the European Law.? The goal of this Thesis is a complex analysis of decisions of the Constitutional Court that are concerned with the nature of the European Law, its effects on national law, and their relation to each other. At first, the Thesis deals with definitions of terms used in the Thesis as well the explanations of the most important principles of the European Law and its effects in national laws of member states as they were formed in decisions of the Court of justice of the European Union. Second, the Thesis briefly deals with approach of several national institutions that are empowered to form binding explanations of before mentioned principles. The position of the Constitutional Court of the Czech Republic to the European Law is fundamental for this Thesis, as it was this Court that was given power to answer all questions regarding the European legal principles after the Czech Republic joined the EU. Gradually, questions regarding the anchoring of the European Law into Czech national law, the effects of the European Law in the national system and the limits the Constitutional Court creates, the question whether the constitutional arrangement has changed after the Czech Republic became a member of the EU as well as the institute of the preliminary question, and the shift in perception of national sovereignty are analyzed. The Thesis also examines (both from material and formal point of view) the first cases of preliminary control of constitutionality of international treaties, which the Constitutional Court had resolved e.g. in the case of the Lisbon Treaty. It studies a recent, very surprising finding of the Court. As conclusion, the Thesis summarizes the basic principles concerning the relationship of the Constitutional and European Laws, which can be deduced from the findings of the Constitutional Court.
