Abstract:

Rodina je označována jako společenský systém, ze kterého její dospělí příslušníci bez ohledu na to, k jaké kultuře náležejí, odvozují svoji identitu. Z toho vyplývá, že zá-kladní funkce rodiny se ve svém celku v průběhu staletí téměř nezměnily. Dostávají však jiné akcenty. Mezi základní čtyři funkce rodiny dle Schelskeho patří: specifická péče (nejen o děti, ale i mezi generacemi), pohlavní partnerství, plození a výchova nového pokolení, ekonomické zabezpečení a stabilita mezi manžely. Dnes některé druhy péče o rodinné příslušníky přecházejí více na stát, ekonomické zabezpečení rodiny je v rukou obou manželů, také plození dětí není dnes těžištěm zakládání rodiny, což dokazuje neustále se snižující populace. Taková forma soužití má vliv a dopad na výchovu dětí, na vztah rodičů a dětí a muže a ženy navzájem. Dnes má mnoho mladých lidí tendenci žít spolu jen tak, bez obřadu, bez sňatku jako právního institutu. Nevidí v takové soužití žádnou zvláštnost a neváhám říct, že je to pro ně moderní záležitost. Zda je to změnou hodnotového žebříčku, či dnešní uspěchanou neformální dobou, nebo za to může stírání mužských a ženských rolí, nad tím nepřemýšlí. Oprávněně si můžeme položit otázku: ?Kde jsou tradiční hodnoty manželství a rodiny?? ? A co na to říká náš právní řád?? Tato dilemata jsou předmětem mé diplomové práce.

Abstract:

Family is marked as a social system from which its adult members inherit their identity regardless of the culture they belong to. This implies that the basic family functions have not practically changed during centuries on the whole. Nevertheless they are given other accents. According to Schelsky, there are four basic family functions: specific care (not only of children but also between generations), sexual partnership, procreation and upbringing of a new generation, economic support and stability between the spouses. Nowadays some kinds of care of family members have been taken over by the state, economic support is in the hands of spouses, and procreation of children is not a decision point of starting a family today, which continual decreasing population improves. Such a form of coexistence has an influence and impact on upbringing of children, on relationship between parents and children and between a woman and a man. Nowadays a lot of young people have a tendency to live together without a marriage and a wedding ceremony as a legal institution. They cannot see any strangeness in such partnership and I do not hesitate to say that it is a modern thing for them. They do not think if it is due to change of value ladder or due to present hurried informal time or if it is a fault of female and male role devaluing. We can rightfully ask the question: ?Where are the traditional values of marriage and family? And what does our legal order say?? These dilemmas are the topic of my thesis.
