Abstract:

Dizertace pojednává o jazykových problémech laiků při sebeobhajobě u soudu. Práce se opírá o materiály z občanského soudního sporu McDonald’s Corporation verzus Helen Steel a David Morris, který byl projednávan v UK High Court v Londýně od června 1994 do prosince 1996. Cílem dizertace je provést jazykovou analýzu dvou laiků, tj. paní Steelové a pana Morrise. Analýza se soustřeďuje pouze na křížový výslech, protože právě během křížového výslechu vzniká mnoho lingvistických a interakčních komplikací pro laiky. Dizertace se zaměřuje na způsob, jakým paní Steelová a pan Morris udržují kontrolu nad svědky, a porovnává jejich otázky a pragmatické strategie s otázkami a strategiemi profesionálního právníka zastupujícího McDonald’s. Zdlouhavý průběh tohoto sporu umožňuje zkoumat, zda laikové během té doby zlepšili svoje dovednosti ve vedení křížového výslechu.

Abstract:

The dissertation deals with linguistic problems lay people experience when representing themselves in court. The data are drawn from a non-jury case McDonald’s Corporation v. Helen Steel and David Morris tried in the UK High Court between June 1994 and December 1996. The aim of the dissertation is to pioneer research into the needs of self-represented litigants by closely considering the language of the two litigants-in-person, Steel and Morris. The focus is exclusively on the cross-examination stage of the proceedings since it is cross-examination that poses many linguistic and interactional challenges to pro se litigants. The dissertation deals with the way Steel and Morris maintain control over witnesses and contrasts their cross-examination questions and strategies with those of the professional counsel representing McDonald’s. An unusually long duration of the hearings (the hearings lasted from June 1994 till December 1999) makes it possible to explore whether in the course of the case the two litigants-in-person improved their cross-examination skills and learned from the counsel.
