The Right to Self-Determination of Nations vs. Principle Uti Possidetis: A Comparative Study of South Sudan and Somaliland

Abstract:

Práce pojednává v komparativné perspektivě o právu národů na sebeurčení v postkoloniální Africe. Tento koncept je zkoumán v kontrastu k principu uti possidetis, tedy neporušitelnosti koloniálních hranic. Na základě různých teoretických konceptů, např. nápravné sebeurčení nebo teorie primární secese, jsou hodnoceny možnosti teritoriálních celků na samostatnou existenci v postkoloniální Africe. Teoretické koncepty, které jsou vysvětleny v první části práce, jsou následně aplikovány na dvě případové studie, Jižní Súdán a Somaliland. Každý případ je zkoumán v historické perspektivě, protože to jsou právě historické okolnosti, které zapříčinily požadavky obou případů na sebeurčení. Zvláštní pozornost je věnována také odlišným postojům mezinárodního společenství, zvláště mezinárodních organizací jako je Africká unie a států regionů Afrického rohu a východní Afriky, k těmto dvěma případům. Závěrečná část hodnotí na základě představených teoretických konceptů, proč se Jižnímu Súdánu podařilo dosáhnout mezinárodního uznání, avšak Somaliland je prozatím ve svých snahách neúspěšný.

Abstract:

The dissertation thesis deals with the right to self-determination of nations in the comparative perspective. This concept is analyzed in the contrast to the uti possidetis principle, which means the inviolability of colonial borders. Based on various theoretical concepts, such as the remedial rights theory or the primary rights theory, possibilities to independent existence of territories in post-colonial Africa is being evaluated. Theoretical concepts, that are explained in the first part of the thesis, are applied to two case studies, South Sudan and Somaliland. Each case is examined in the historical perspective, since they are historical circumstances which have caused the claims to self-determination of both cases. The special attention is paid to the postures of international community, the international organizations such as African union and the states in the Horn of Africa as well as East Africa in particular, to these two cases. The concluding part of the thesis evaluates why has South Sudan managed to gain international recognition, while Somaliland is still unsuccessful in its efforts.
