Selected Aspects of Communicative Competence in Legal English for Academic Purposes - Needs Analysis

Abstract:

Disertační práce se na platformě analýzy potřeb zabývá procesem určení specifik komunikační kompetence v právním anglickém jazyce pro akademické účely (KK PAAJ) pro potřeby tvorby kurikula PAAJ jako subvariety anglického jazyka pro specifické účely (ESP). Téma disertační práce bylo vybráno s ohledem na důležitost ESP v rámci terciární úrovně vzdělávacího systému v České republice. Vzhledem ke svému zaměření na jazykové praktiky profesních či jinak specifických diskurzních komunit, využívá ESP ke zjištění komunikačních nároků, které jsou na profesionály kladeny v rámci reálných pracovních situací, právě analýzu potřeb. Význam analýzy potřeb v oblasti právního anglického jazyka (PAJ) jako variety ESP je dále potvrzen globální a lokální povahou právního vzdělávání, kdy výuka práva musí zohledňovat jak nadnárodní trendy, tak specifika místních národních řádů. Ve snaze postihnout specické aspekty profesních cílových situací na co nejširší bázi a zároveň reflektovat dichotomii jazyka jako systému (usage) a jeho praktického užívání (use), byl výzkum rozdělen do dvou základních větví zjišťujících charakteristické rysy PAJ v oblasti řečových dovedností (use) (V1) a vybraných jazykových prostředků (usage) (V2). Finálním cílem nicméně bylo syntetizovat získaná specifika v rámci společného závěru, který poskytne didaktická doporučení pro tvorbu kurikula PAAJ, jako subvariety PAJ obohacené o akademickou komponentu. Teoretická část disertace se zabývá vymezením klíčových konceptů, kterými jsou: (i) ESP, (ii) anglický jazyk jako lingua franca (ELF), (iii) PAJ, (iv) PAAJ, (v) lexikální shluky (LS) jako lexikálně-gramatické jednotky reprezentující v našem výzkumu oblast jazykových prostředků a (vi) analýza potřeb jako ústřední přístup aplikovaný v této studii. Teoretická část práce dále předkládá přehled studií v oblastech, které výše zmíněné koncepty představují. Empirická část nejdříve uvádí cíl výzkumu, výzkumné otázky, design výzkumu a výzkumný vzorek. Výzkumná větev zabývající se identifikací specifik řečových dovedností (V1) je kvalitativně zaměřenou studií, v jejímž rámci bylo realizovány polostrukturované rozhovory se 14 respondenty (dostupný vzorek) reprezentujícími tři profesní sféry (akademická, státní, soukromá). Zvukové záznamy rozhovorů byly doslovně přepsány a manuálně, tedy bez použití specializovaného softwaru, kódovány za pomoci nezávislého kódovatele za použití apriori definovaných kategorií. Druhá výzkumná větev zjišťující specifické rysy v oblasti jazykových prostředků (V2) se zaměřila 4 žánrově vymezené korpusy, které byly kompilovány za využití textů poskytnutých respondenty v průběhu výzkumných rozhovorů. K tomuto účely byly realizovány dvě lingvistické analýzy, kdy první z nich byla provedena dle principů analýzy registru (Biber & Conrad, 2009) (A1), zatímco druhá využívala metodologie Breezové (2013) (A2). Analýzy (A1, A2) se vyznačovaly smíšeným výzkumným designem, kdy extrakce LS byla provedena kvantitativně, zatímco kódovaní za pomoci druhého kódovatele a apriorně definovaných kategorií, spadá do kvalitativně orientovaného výzkumu. V následující části textu disertace jsou prezentovány výsledky a je uvedena jejich interpretace vzhledem k hlavní výzkumné otázce. V první větvi výzkumného šetření (V1) byla určena specifika řečových dovedností vzhledem k jejich proporčnímu zastoupení v rámci profesních cílových situací a dále byly vymezeny charakteristické rysy řečových dovedností z hlediska jejich dílčích lingvistických, sociolingvistických a pragmatických kompetencí, včetně jejich dílčích subkompetencí. větvi výzkumu zahrnují: (i) dominantní postavení řečové dovednosti čtení v portofoliu všech řečových dovedností napříč skupinami respondentů (akademická sféra 43 %, státní správa 61 %, soukromá sféra 20 %), (ii) význam sémantické a lexikální subkompetence vzhledem k existenci anglického jazyka jako rodilého jazyka pro systém zvykového práva a jako ELF pro systém kontinentálního práva (zejména v řečové dovednosti čtení), (iii) důležitost sociolingvistické kompetence u právníků pracujících s klienty bez právního vzdělání (akomodační teorie, zejména v řečové dovednosti mluvení), (iv) aplikace či suspendování konverzačních maxim v rámci pragmatické kompetence (zejména v řečové dovednosti mluvení v rámci interakcí s klienty), (v) důležitost diskurzní subkompetence v rámci týmové tvorby psaných dokumentů realizované na platformě kolegiálních i konkurenčních pracovních vztahů (řečová dovednost psaní). V rámci druhé výzkumné větve (V2) byly LS specifikovány zejména vzhledem k frekvenci výskytu, strukturální a funkční klasifikaci, a v neposlední řadě s ohledem na přímou návaznost s obsahem textu. Vybrané výsledky v této části výzkumu zahrnují následující aspekty: (i) velmi vysoká frekvence výskytu LS generovaných v rámci obou analýz (A1,A2), (ii) převládající míra žánrově specifických LS nad obecně akademickými LS (A1), (iii) významná míra LS plnících referenční funkci a kohezní funkci, (iv) vhodnost metodologie A2 k získávání LS vykazujících okamžitou souvislost s obsahem textu, a přispívající tak ke koherenci textu. Interpretace výsledků získaných v obou větvích výzkumu byly využity pro formulaci doporučení pro tvorbu kurikula PAAJ v závěrečné části textu disertace. Prezentovaný výzkum je určen především vyučujím PAAJ na právnických fakultách. Věříme že, jako takový přispěje do diskuze o ústředním postavení analýzy potřeb v rámci tvorby kurzů ESP a poskytne specifická doporučení pro design kurikula v oblasti PAAJ, jak s ohledem na řečové dovednosti a jejich dílčí kompetence a subkompetence, tak na poli specifik v oblasti lexikálně-gramatických jednotek v rámci právních textů. V neposlední řadě doufáme, že informace týkající se dílčích aspektů KK PAAJ najdou své čtenáře rovněž mezi stávajícími studenty práva.

Abstract:

Using the approach of needs analysis, the present dissertation thesis aims to define the specific aspects of the communicative competence in the area of Legal English for Academic Purposes (LEAP) as an English for Specific Purposes (ESP) subvariety. The ascertained specifics will be used to formulate curriculum recommendations for LEAP courses in higher education in the Czech Republic. The dissertation topic was chosen to reflect the importance of the field of ESP in contemporary tertiary level foreign language education in the Czech Republic. Due to its focus being on the language practices of professional or otherwise specific discourse communities, ESP uses needs analysis as the central approach to ascertain specifics of communication requirements imposed on users of English as a lingua franca (ELF) within real-life work-related situations. The significance of needs analysis for Legal English (LE) as an ESP variety is further confirmed by the global as well as local nature of legal education, where instruction of law needs to take into account both the supranational trends as well as local specifics of national legal orders . In an effort to provide as broad an information basis as possible about the target professional situations and in an attempt to reflect the use and usage dichotomy of language learning and teaching, I have chosen to divide the present research study into two branches, where language skills and language systems were analyzed separately. The final aim, however, was to synthesize the obtained results into a common conclusion where didactic recommendations for the teaching LEAP as an LE subvariety enriched by an academic component were offered. The theoretical part of the dissertation thesis introduces the key concepts for the present study. These include communicative competence, ESP, ELF, LE as chosen ESP variety and LEAP as a chosen ESP subvariety, lexical bundles (LBs) as lexico-grammatical units selected to represent the domain of language systems as well as needs analysis as the central approach adopted for this study. The theoretical part then presents an overview of major research studies conducted in the domains the above mentioned concepts represent. The empirical part firstly deals with the research aim, research questions, research design, and research sample. The research branch concerned with the identification of language skills specifics (R1) was a qualitative research study where semistructured interviews with 14 legal professionals (convenience sampling) representing three work-related domains (academic, state, private) were conducted and their sound recordings transcribed and manually tagged (thematic coding) with the assistance of a second rater using pre-defined categories. The other branch examining the language system specifics, namely LBs (R2), did so by exploring the four genre defined corpora of legal texts which were compiled using the texts provided by the respondents during the interviews. Two linguistic analyses, namely the analysis using the register approach (Biber & Conrad, 2009) (A1) and the analysis employing the methodology of Breeze (2013) (A2), of mixed research design were carried out. In both of them data were obtained quantitatively using corpus linguistic tools and subsequently manually tagged by two raters using the categories established in the LB research. In the next part, the results of both the research studies are listed and interpreted in view of the main research question. In the first branch (R1) the specifics of language skills are given where frequency of use of individual language skills is identified and the specifics in the area of linguistic, sociolinguistic and pragmatic competences and their respective subcompetences are explained. phere 20 %), (ii) importance of semantic and lexical subcompetences due to the English as a native language in common law and English as ELF in continental law dichotomy (particularly in reading comprehension) , (iii) importance of sociolinguistic competence for lawyers working with clients without legal background mainly in the area of accommodation theory (particularly in speaking), (iv) the issue of applying or suspending conversational maxims within pragmatic competence (particularly in spoken client interaction), (v) importance of discourse subcompetence in team-based written text creation both on the platform of collegial and competitive work relationships (writing). In the second branch of the research (R2), LBs are specified mainly in terms of their frequency, structural as well as functional classification, and the degree of explicit connection to text content. Here the selected results include: (i) very high frequency of LBs generated within both analyses (A1, A2), (ii) prevalence of legal genre specific LBs over general academic LBs in A1, (iii) dominance of LBs with referential function which play a crucial role in terms of text cohesion (A1), (iv) suitability of the A2 methodology in generation of LBs which show an immediate link to text content and thus perform an essential role in terms of text coherence. The interpretation of the results obtained from both research branches are used to produce recommendations for the LEAP curriculum design in the final part of the dissertation thesis. The intended readers of the present research study primarily include LEAP practitioners. In this respect I believe the research will both contribute to the discussion on the centrality of needs analysis in ESP course design and provide specific recommendations for LEAP curriculum creation particularly in terms of the importance of various language skills and their constituent competences and subcompetences as well as regarding specifics in the area of lexico-grammatical units in legal texts. I also hope the specifics regarding the language skills and LBs will find its readership among the current students of law.
