Constitutional Court and a constitutional complaint

Abstract:

The main aim of the thesis Constitutional court and the constitutional complaint is to present the beginning of constitutional justice both in the world and in the conditions of the Slovak Republic, processing of concise and comprehensive overview of an internal organization of the Constitutional court in the Slovak Republic, the analysis of its competence regarding the Institute of a constitutional complaint. This Bachelor thesis includes an introduction, three chapters devided into sub – headings and a conclusion. The introduction points out the theme of the thesis and specifies its aim. The first chapter focuses on the genesis and importance of constitutional justice. The second chapter duscusses the organization, competencies, roles and status of constitutional justice in the conditions of the Slovak Republic based on current legislation and analyzes the proceedings before Constitutional court of the Slovak Republic. Considering particular issue it defines the general characteristics of submissions to the Constitutional Court of the Slovak Republic, distinguishes between particular phases of the proceedings before the Constitutional Court, as well as the types of decisions of the Constitutional Court. The third chapter processes a theoretical analysis of the constitutional complaint. The conclusion points to necessity and importance of control and protection of constitutionality, highlights the positives and defaults.

Abstract:

Hlavným cieľom bakalárskej práce Ústavný súd a ústavná sťažnosť je prezentácia vzniku ústavného súdnictva vo svete a v podmienkach Slovenskej republiky, spracovanie stručného a uceleného prehľadu vnútornej organizácie Ústavného súdu Slovenskej republiky, analýza jeho pôsobnosti so zreteľom na inštitút ústavnej sťažnosti. Bakalárska práca obsahuje úvod, tri kapitoly rozčlenené na podkapitoly a záver. Úvod práce oboznamuje s témou práce a vymedzuje jej cieľ. Prvá kapitola je zameraná na genézu a význam ústavného súdnictva. Druhá kapitola rozoberá organizáciu, kompetencie, úlohy a postavenie ústavného súdnictva v podmienkach Slovenskej republiky na základe platnej legislatívy a analyzuje konanie pred Ústavným súdom Slovenskej republiky. V rámci danej problematiky vymedzuje všeobecnú charakteristiku podania na Ústavný súd Slovenskej republiky, diferencuje jednotlivé fázy konania pred ústavným súdom, ako aj typy rozhodnutí ústavného súdu. Tretia kapitola rozpracúva teoretickú analýzu ústavnej sťažnosti. Záver práce poukazuje na nevyhnutnosť a význam kontroly a ochrany ústavnosti, poukazuje na pozitíva a nedostatky.
