Abstract:

Tato diplomová práce se zabývá tématem dohodou o vině a trestu. Práce má přinést teoretické poznatky o tomto institutu a to i v rámci jeho fungování. Teoretická východiska mají přispět k porozumnění institutu jako takového a současně sloužit jako základ pro praktickou část. Praktická část se zabývá kvalitativním výzkumem, jehož součástí je analýza konktrétních případů poskytnutých Krajským státním zastupitelstvím v Brně a také i oddělením obecné kriminality. Zároveň je součástí praktické části i řízený rozhovor s prezidentem Unie státních zástupců ČR, který má svými zkušenostmi tuto práci obohatit o poznatky z praxe. Tato diplomová práce má shromáždit poznatky o tomto poměrně novém institutu a i to včetně informací, zda opravdu tento institut dohody o vině a trestu přispívá v praxi k premisy zjednodušení, zrychlení a zefektivnění soudního procesu.

Abstract:

This thesis deals with the topic of the agreement on guilt and punishment. It is intended to provide theoretical knowledge about this institution and in the framework of its functioning. The theoretical background is to contribute to the understanding of the institute as such and at the same time to serve as a basis for the practical part. The practical part deals with qualitative research, which includes the analysis of concrete cases from the Regional Public Prosecutor's Office in Brno and also from the General Crime Department. At the same time, the practical part also includes a guided interview with the President of the Union of Public Prosecutors of the Czech Republic, whose experience is to enrich this work with insights from practice. This thesis is intended to bring awareness of this relatively new institution, including information on whether this institution of plea bargaining really contributes in practice to the premise of simplifying, speeding up and streamlining the judicial process.
