Easements in Czech law

Abstract:

The goal of my bachelor thesis is analysis of current legislation of easements. My bachelor thesis is divided by ten chapters focused on approaching the issue of easements, development and current legislation. Furthermore it describes the legal regulations of easements. Chapters which deal with current legislation shows subject of easements, method of formation, forfeiture and discharge of easements. My bachelor thesis shows different types of easements which are provided by current legislation. The thesis object of research is to confirm the hypothesis that the easement is the easiest and most economical way of resolving disputes, even in situations where there may be a different solution. The bachelor thesis analyses the legal regulations of easements from their origin to the present and refers to specific cases where it is possible to establish an easement. We have found out that the current legislation is sufficient for people's everyday needs. The hypothesis that it is most effective to settle disputes by easement, although it is possible to settle the dispute in a different way, has been confirmed.

Abstract:

Cieľom práce je prevedenie analýzy platnej právnej úpravy verejných bremien. Práca je rozdelená do desiatich kapitol, ktoré približujú problematiku vecných bremien, ich vývoj a súčasnú právnu úpravu. Práca popisuje právnu úpravu vecných bremien od ich historického vývoja až po súčasnú právnu úpravu. Kapitoly venujúce sa súčasnej právnej úprave približujú predmet vecných bremien, spôsoby vzniku, premlčania a zániku vecných bremien. Bližšie popisujú jednotlivé druhy vecných bremien, ktoré sú zákonom ustanovené. Objektom skúmania práce bolo potvrdenie hypotézy, že vecné bremeno je najefektívnejším spôsobom riešenia situácií i tam, kde je možné aj iné riešenie. Práca analyzuje právnu úpravu vecných bremien od ich vzniku až do súčasnosti a poukazuje na konkrétne prípady, kedy je možné vecné bremeno zriadiť. Zistili sme, že súčasná právna úprava je dostačujúca pre bežné potreby ľudí a hypotéza, že riešenie sporov zriadením vecného bremena je najefektívnejšie, aj keď je možné spor vyriešiť iným spôsobom, sa potvrdila.
