Civil Rights and Liberties in the Czechoslovak Constitutional Development in the Years 1948 - 1960

Abstract:

Tématem práce, jsou občanská práva a svobody v československém ústavním vývoji v letech 1948 ? 1960. Jejím cílem je pak analýza ochrany občanských práv a svobod deklarovaných státem ve vztahu ke skutečnému stavu uplatňovanému v totalitním režimu. Práce je rozdělena do osmi samostatných kapitol, včetně úvodu a závěru. Vlastní text práce tedy začíná kapitolou druhou, jež definuje ve dvou dílčích kapitolách základní pojmy práce, jimiž jsou jednak občanská práva a svobody a dále ústava a její vývoj. Třetí kapitola je věnována historickému exkurzu do doby před počátkem zkoumaného období, tedy do roku 1948. Je rozdělena třemi dílčími kapitolami na období předválečného, válečného a poválečného politického vývoje, jenž směřoval k následnému komunistickému převratu. Kapitola čtvrtá se tedy logicky zabývá událostmi souvisejícími se zmíněným převratem, které jsou rozděleny do čtyř dílčích kapitol. Jedná se tedy o únorový převrat, následuje popis nového politického zřízení, jeho dopad na společnost a samostatně pak jeho dopad do oblasti práva. V kapitole páté je rozbor ústavního vývoje ve zkoumaném období, ve čtyřech částech je zde uvedena příprava ústavy, následuje její přijetí, dále její změny a doplňky a v poslední části její vliv na společenský vývoj. Kapitola šestá je patrně nejdůležitější pro tuto práci, neboť je věnována přímo občanským právům a svobodám, tak je garantovala tehdejší ústava ve srovnání jejich uplatňování ve skutečnosti. Toto srovnání je provedeno v deseti dílčích částech, navazujících na jednotlivá ustanovení ústavy. V závěrečné kapitole sedmé je provedeno srovnání ochrany občanských práv a svobod v Československu té doby oproti demokratickému světu. Sumarizace celé problematiky je obsažena v závěru.

Abstract:

The theme of the Thesis is the civil rights and liberties in the Czechoslovak constitutional development in the years 1948-1960. Its goal is the analysis of the protection of civil rights and liberties declared by the State in the relationship to the actual status applied under the totalitarian regime. The thesis is devided into eight individual chapters, including the Introduction and Conclusion. Thus, the actual text of the thesis begins with Chapter Two which, devided into two partial chapters, defines the basic terms of the Thesis, i.e. the civil rights and liberties and the Constitution and its development. The Third Chapter is dedicated to the historical digression into the era before the researched period, i.e. back to the year 1948. It is divided into three sub-chapters - the period of the pre-war, wartime and post-war political development that was heading towards the subsequent communist revolution. Chapter Four is logically dealing with the events connected with the above mentioned revolution, which events are divided into four sub-chapters: the February revolution, the subsequent description of the political system, its impact on the society and its impact on the legal system. The Fifth Chapter deals with the analysis of the constitutional development during the researched period, again presented in four parts: the preparation of the Constitution, its acceptance, changes and ammendments and in the last part - its influence on the social development. The Sixth Chapter is apparently the most important in this Thesis, since it is devoted directly to the civil rights and liberties, so as they have been guaranteed by the Constitution at that time, in comparison with their enforcement in reality. This comparison has been performed in ten partial sections following up the individual provisions of the Constitution. The concluding Seventh Chapter, compares the protection of civil rights and liberties in Czechoslovakia at that time with the remaining democratic world. The Summary of the entire theme is covered in the Conclusion.
