Abstract:

This bachelor thesis is focused not only on the American legal system which differs considerably from the European one but also on trial courts or courts of first instance where a jury plays an important role. The aim of the work is to introduce the phenomenon of jury which decides on the defendant´s guilt or innocence. Besides, information concerning the structure of a jury is provided. Moreover, the process of selection of a jury is discussed in detail as well as the rules by which jurors must abide. The part of the thesis is an example of the criminal case which is used to present and describe how a trial by jury proceeds in practice.

Abstract:

Tato bakalářská práce je zaměřena nejen na americký právní systém, který se značně liší od evropského, ale také na soudy první instance, kde porota hraje důležitou roli. Cílem této práce je představit fenomén poroty, která rozhoduje o vině a nevině obžalovaného. Kromě toho, poskytuje informace týkající se struktury poroty. Rovněž je podrobně popsán proces výběru poroty, stejně jako pravidla, kterými se musí porotci řídit. Součástí této práce je vzorový příklad trestního případu, pomocí něhož je vylíčeno jak proces před porotou prakticky probíhá.
