Development stages of criminal offence

Abstract:

Tato diplomová práce se zabývá odvětvím trestního práva, a to konkrétně vývojovými stadii trestného činu. Institut vývojových stadií trestného činu je velmi zajímavou, rozmanitou a důležitou oblastí trestního práva. Jelikož trestní právo ve společnosti funguje jako ?ultima ratio?, tedy jako poslední možnost, kdy není možné uplatnit jiný předpis, je třeba rozlišovat vývojová stadia trestného činu, abychom věděli, od kdy nastupuje trestní odpovědnost, od kdy vstupuje na scénu trestní právo. Práce je rozdělena do jedenácti kapitol, které se dále člení na subkapitoly. Po úvodu se v začátku práce věnuji obecnému vysvětlení pojmů vývojová stadia a trestný čin. Poté následuje kapitola věnovaná historickému vývoji úpravy na našem území. Dále jsou kapitoly členěny dle jednotlivých stadií. Věnují se přípravě trestného činu, pokusu trestného činu, jejich společným zásadám, trestnosti a trestání přípravy a pokusu, dokonání trestného činu a nechybí ani úvahy de lege ferenda. Ve své práci jsem dal prostor i srovnání s Italskou právní úpravou této problematiky. Závěr obsahuje shrnutí celé práce.

Abstract:

This diploma thesis deals with the branch of criminal law namely development of criminal offense. The institutive of criminal offense development phases is very interesting, various and important area of criminal law. Although criminal law works in society like ?ultima ratio?, and so as the last chance, when it is not possible to use another regulation, it is necessary to distinguish development phases of criminal offense to know since when liability commences and since then criminal law takes the stage. The diploma thesis is divided into eleven chapters which are furthermore divided into subchapters. After introduction in the beginning of the thesis I am dealing with the general explanation of the terms ? development phases ? and criminal offense. After that there is a chapter devoted to historical development of the modification in our area. Furthermore the chapters are divided according to individual stages. They are dedicated to a preparation of a crime, their common principles, to punishability and punishing a preparation and an attempt, accomplishing of a crime and consideration de lege ferenda is also presented. I also emplaced comparison with Italian legal modification of these problems. The conclusion incorporates the summary of the whole thesis.
