Atittude to punishment in the Czech Republic and Denmark: A role of belief in a just world

Abstract:

Tato práce si klade za cíl zjistit, jestli se liší dánská a česká populace v různých ospravedlnění trestu v trestněprávním kontextu a jakou roli v postoji k trestu hraje víra ve spravedlivý svět. Výzkum zahrnuje tři teorie trestu - retribuční (cílem je odplata za zločin), eliminační (cílem je izolace pachatele) a odstrašující (cílem je odstrašení pachatele). Teoretickým východiskem pro rozdíl v postoji k trestu je odlišnost české a dánské společnosti ve vybraných společenských aspektech, konkrétně ve způsobu prezentace zločinu v médiích, strachu ze zločinu, důvěry ve státní instituce a společenské solidaritě a homogenitě. První studie ověřuje předpoklad, že implicitní i explicitní postoj k trestu je v Dánsku více založen na utilitárních teoriích (eliminační a odstrašující teorie) než v České republice a také že explicitní postoj obou národnostních vzorků je více utilitární než implicitní postoj. Druhá studie zkoumá vztah mezi postojem k trestu a vírou ve spravedlivý svět. Použili jsme dotazník postoje k trestu, měřící implicitní a explicitní postoj participantů ke třem teoriím trestu, a dotazník víry ve spravedlivý svět. Výzkumný soubor první studie tvořilo 211 osob, převážně vysokoškolsky vzdělaných mladých dospělých, z toho 81 Dánů a 130 Čechů. Výzkumný soubor druhé studie tvořilo 122 Čechů. Sběr dat probíhal umístěním dotazníku na sociálních sítích. Pro analýzu dat byla využita one-way ANOVA pro opakovaná měření, t-test pro nezávislé výběry, t-test pro závislé výběry a korelační analýza. Z výsledků vyplývá, že implicitní postoj Dánů a Čechů k trestu se neliší, v obou případech je preferována retribuční teorie, tedy je důraz kladen na odplatu za spáchaný zločin. Rozdíl však nacházíme v explicitním postoji k trestu, v Dánské populaci je totiž preferována eliminační teorie nad retribuční. Nesoulad mezi implicitním a explicitním postojem k trestu nacházíme v české i dánské populaci, u Dánů je však markantnější. Vztah s vírou ve spravedlivý svět nebyl prokázán. Diskutujeme význam tohoto zjištění a navrhujeme vysvětlení. Diskutujeme roli víry ve spravedlivý svět v preferenci retribuční teorie: Předpokládáme, že retribuční postoj k trestu slouží jako mechanismus k udržení víry ve spravedlivý svět. Shrnujeme implikace pro praxi a navrhujeme další směr výzkumu v této oblasti.

Abstract:

The thesis aimed to find out whether Danish and Czech population differ in preference of justifications of punishment in a criminal context. The research included three theories of punishment – retribution, incapacitation and deterrence. Theoretical background for the difference in attitudes to punishment was the difference of Czech and Danish society in particular social aspects, specifically the way of presenting crime in media, fear of the a crime, trust in state institutions and social solidarity and homogenity. A first study verifies an assumption that implicit and explicit attitude towards punishment are more based on utilitarian theories (incapacitation and deterrence) in Denmark than in the Czech Republic and also that explicit attitude of both national samples is more utilitarian than implicit attitude. A second study examines a relationship between attitude to punishment and belief in a just world. We used a questionnaire measuring implicit and explicit attitude of participants towards the three theories of punishment and a questionnaire of belief in a just world. A sample of the first study consisted of 211 people, mostly young adults with university education, from which 81 were Danes and 131 were Czechs. A sample of the second study consisted of 122 Czech participants. The data were collected through a social network. To analyze the data we used one-way ANOVA for repeated measures, t-test for independent samples, t-test for dependent samples and correlation analysis. Our results indicate that implicit attitude of Danes and Czechs doesn’t differ, retribution theory is preferred in both cases. However we find a difference in explicit attitude towards punishment, Danes prefer incapacitation theory over retribution theory. We find the incongruence between implicit and explicit attitude in both samples, Czech and Danish, but it is greater in the Danish sample. A relationship with belief in a just world wasn’t proved. We discuss the importance of this finding and we offer an explanation. We discuss a role of belief in a just world in preference for retribution: We suppose that retributive attitude to punishment serves as a mechanism sustaining belief in a just world. We summarize practical implications and suggest a direction of next research in this field.
