Regulation of Trade in Firearms

Abstract:

Tato bakalářská práce se zabývá problematikou mezinárodního obchodu se střelnými zbraněmi a vojensky využitelným materiálem, zaměřuje se přitom na podmínky platné v České republice. V první, teoretické části práce, jsou rozebrány platné mezinárodní závazky České republiky v oblasti regulace mezinárodního obchodu se sledovaným zbožím, které souvisejí s již uzavřenými mezinárodními dohodami, jichž je Česká republika účastna, včetně popisu existujících mezinárodních kontrolních mechanismů v této oblasti. Obsahem této části je rovněž historický náhled přístupu Evropské unie k regulaci a šíření zbraní, dále je též popsána existující česká právní úprava dovozu a vývozu zbraní a související problematiky nakládání se zbraněmi. Ve druhé, praktické části jsou pak konkrétně uvedeny podmínky a postup pro získání odpovídajících oprávnění k realizaci přeshraničních obchodních případů, dále jsou na několika smyšlených modelových případech ukázány rozdíly přístupu k udělování povolení mezi vývozy a dovozy, mezi různými druhy střelných zbraní i mezi různými cílovými zeměmi. Následně jsou pak na základě veřejně dostupných údajů uvedeny informace o uskutečněných reálných dovozech a vývozech střelných zbraní do nebo z České republiky v roce 2009. V závěrečné části práce jsou uvedeny některé problémy a nedostatky, které se navzdory skutečné praxi v právní úpravě dosud vyskytují. Veškeré uvedené informace vycházejí z volně dostupných zdrojů, literatury, zákonů a mezinárodních smluv, z internetových zdrojů. Informace uvedené v praktické části jsou pak obohaceny o poznatky získané z osobních rozhovorů s představiteli státních institucí působících v oblasti obchodu a kontroly nakládání se zbraněmi a střelivem, tedy představitelem Licenční správy Ministerstva průmyslu a obchodu ČR a též policistou z místního útvaru pro zbraně a střelivo Policie České republiky.

Abstract:

This thesis deals with the topic of international firearms and military equipment trade while focusing on the conditions valid in the Czech Republic. The first, theoretically oriented part of the thesis discusses currently valid international commitments of the Czech Republic in the field of regulations of international trade with the selected goods. This is closely related to the already sealed international agreements, which the Czech Republic participates on, including the description of existent international control mechanisms in the respective field. This part of the thesis also includes a historical insight into the development of how the EU perceived the regulations of firearms, while the current Czech laws concerning import and export of weapons and the related issues of dealing with them are also described. The second, practically oriented part of the thesis describes particular conditions and practices how to obtain authorization for international trade. Examples of differences in granting permission for import and export of various goods from and to different countries are demonstrated on model cases. The thesis also lists all publicly accessible data relating to executed exports and imports of firearms from and to the Czech Republic in 2009. The final part of the thesis gives examples of several problems and inadequacies of the current legislatives that are still present despite the laws being in use. All used data are drawn from publicly available sources, books, laws and international agreements and from online sources. The data used in the practical part of the thesis are also enriched by knowledge acquired during personal interviews with representatives of state institutions dealing with trade and control of firearms (Licensing Office of the Ministry of Industry and Trade, police officer from a local division for weapons and ammunition).
