Concepts of Good Faith, Good Manners, Public Morality and Public Order in Czech Private Law
Abstract:
Tato práce se zabývá pojmy dobrá víra, dobré mravy, veřejná morálka a veřejný pořádek, které patří mezi tzv. neurčité právní pojmy. Cílem je provést právní klasifikaci uvedených pojmů, shrnout jejich výskyt v ustanoveních českého soukromého práva a zejména za pomoci judikatury tak objasnit jejich význam a použití v jednotlivých případech.

This thesis is dealing with the concepts of good faith, good manners, public morality and public order which belong among the so-called indefinite legal concepts. The aim of this thesis is to carry out the legal classification of the above-mentioned concepts, to summarize their occurrence in the Czech private law provisions and, in particular, to explain their meaning and application in individual …more
