The Impact of The Office for International Legal Protection of Children on the Family Interactions in the Process of Child Support Enforcement from Abroad

Abstract:

Ve své bakalářské práci se zabývám problémy s neplacením výživného na děti rodičem, který žije v zahraničí. Na problémy s výživným pohlížím optikou sociální práce jako na nerovnováhu v interakcích mezi rodiči a mezi nepřítomným rodičem a dítětem. Od nepřítomného rodiče je požadováno plnění rodičovských funkcí a povinností; někteří rodiče ale tato očekávání nezvládají naplnit. Neplněním vyživovací povinnosti k dítěti rodičem žijícím v zahraničí se systematicky zabývá Úřad pro meziárodněprávní ochranu dětí (Úřad). Ve své práci jsem zjišťovala, v čem a jak tento Úřad dokáže svou činností ovlivnit problémové interakce v rodinách. Provedla jsem případovou studii, data jsem sbírala od osmi matek, které se v minulosti obrátily na Úřad s žádostí o pomoc při vymáhání výživného ze Slovenska. Zjistila jsem, že v některých případech Úřad dokáže svou činností dosáhnout placení výživného, ale dochází k tomu nuceným výkonem rozhodnutí. Matky vyjádřily obavu, zda je tento způsob placení výživného do budoucna udržitelný. Úřad tedy dokáže zajistit placení výživného, ale nedokáže obnovit schopnost nepřítomného rodiče plnit vyživovací povinnost bez donucení. Z případové studie vyšlo najevo, že problém s neplacením je doprovázen vždy také nezájmem nepřítomných rodičů o děti. Úřadu doporučuji zaměřit se na hledání způsobů, jak zajistit dobrovolné placení výživného a případně také podpořit zájem nepřítomných rodičů o děti.

Abstract:

In my bachelor thesis, I deal with the child support payment problems that occur when one parent lives abroad. I use the social work perspective to see the problems to be part of the the family interactions. I believe there is not a balance in the interactions between the parents and between the non-resident parent and the child. Some non-resident parents are not able to cope with the parental capacity and duties that are expected from them. The Office for International Legal Protection of Children (the Office) focuses on the problems with the child support payments from abroad. The goal of my work was to find out how does the Office influence the problematic family interactions. Within a case study, I collected data from eight mothers who addressed the Office in the past and asked for help with the enforcement of the child support from Slovakia. I found out that in some cases the Office was successful and issued that the child support is being paid but that was only by the means of judicial enforcement. The mothers showed concerns about the sustainability of the forced child support payments in the future. I made the conclusion that the Office can enforce the child support from abroad but it is not able to support coping of the non-resident parent with the child support obligation that is expected from him to comply with. The results of the case study also showed that the non-resident parents who do not pay the child support neither show any interest about their children. I recommend the Office to focus on finding the ways to ensure that the non-resident parents pay the child support voluntarily and eventually also to focus on enhancing the interest of the non-resident parents in their children.
