Pre-trial and its Phase from the Perspective of Police Practice

Abstract:

Tato bakalářské práce se zabývá přípravným řízením a jeho fázemi z pohledu policejní praxe“. Cílem bylo nastínit teoretické postupy v rámci přípravného řízení dle trestního řádu a následně porovnat, zda se shodují s běžnou policejní praxí, zda jsou postupy policejního orgánu efektivní, rychlé, hospodárné a zda jsou v souladu s vývojem techniky a modernizací doby. Rovněž je cílem práce poukázat na problematická místa v rámci přípravného řízení a prostřednictvím úvah de lege lata a de lege ferenda navrhnout jejich zlepšení, změnu nebo modernizaci. V praktické části práce jsou pak uvedeny tabulky objasněnosti trestné činnosti za rok 2020 a 2021 na území České republiky, kde je názorně vidět vývoj kriminality a její objasněnosti v průběhu dvou let a zda jsou postupy užívané policejním orgánem efektivní. V závěru je pak zhodnoceno a porovnáno, zda se teoretický výklad právních norem shoduje s reálnou praxí a v jednotlivých kapitolách práce je rovněž poukázáno na nedostatky právní úpravy a mezery či zastaralé postupy v rámci trestního řízení, které by bylo možné upravit, doplnit a modernizovat, a zajistit tak ještě rychlejší a efektivnější výstupy policejního orgánu v trestním řízení, které by však nezasahovalo do práv občanů.

Abstract:

This Bachelor thesis deals with pre-trial and its phase from the perspective of police practice. It´s goal is to outline theoretical methods in pre-trial according to Criminal Procedure and then compare, if they agree with common police practice, if the methods of police organ are effective, fast, economic and if they are in accordance with technical development and modernizations of the time. Also is the goal of this Bachelor thesis to point out problematic places in pre-trial and through reflection de lege lata and de lege ferenda suggest their improvement, change or modernization. In the practical part of these thesis there are placed tables which shows the clarity of criminal activity in 2020 and 2021 on territory of the Czech Republic, where can be clearly seen the development of crime and its clarification over two years and if the methods used by police organs in police practice are effective. In the end of Bachelor thesis there is evaluated and compared if the theoretical interpretation of legal norms agrees with real practice and the individual chapters of the Bachelor thesis points out the shortcomings of the legislation that would be possible to edit, fill in and modernize and ensure even faster and more efficient work outputs of police organ in criminal proceedings which wouldn´t interfere to citizen´s rights.
