Abstract:

Tato práce je rozdělená do šesti věcných kapitol. V kapitole první je popsána historie, pojem a práva majitele ochranné známky. Kapitola stručně popisuje vývoj ochranných známek ve světě, a také na území ČR, a dále zde jsou vysvětleny pojmy ochranné známky a práva majitele ochranné známky. Ve druhé kapitole je vymezeno postavení ochranné známky z pohledu teritoriálního, tudíž zde jsou popsány ochranné známky národní, mezinárodní a komunitární. Následující kapitola popisuje jednotlivé druhy ochranných známek, tak jak je upravuje zákon č. 441/2003 Sb., o ochranných známkách, tedy na slovní, obrazové a prostorová označení, a barvy jako ochranné známky. Kapitola čtvrtá věnuje pozornost netradičním ochranným známkám, které jsou v současné době velmi často zapisovány do rejstříku ochranných známek. Následující podstatná kapitola popisuje proces přihlášení ochranné známky na území ČR. Poslední věcná kapitola této práce vymezuje poplatky za ochrannou známku v České republice a za ochrannou známku Společenství. Výsledkem této práce je souhrn užitečných informací pro veřejnou i neveřejnou společnost. Práce mimo jiné popise současný fenomén ochranných známek, kdy se zákazníci právě podle ochranných známek rozhodují, jaký typ výrobku si zvolí. Z tohoto tvrzení vyplývá, že ochranné známky nejsou pouhými instituty ochrany práv k průmyslovému vlastnictví, ale jsou historicky vžitými a nepostradatelnými objekty lidského vnímání.

Abstract:

This thesis is divided into six substantive chapters. The first chapter describes the history, concept and rights of the proprietor. Chapter briefly describes the development of trade marks in the world, and the Czech Republic, and here are explained concepts trademarks and rights of the owner of the mark. The secondd chapter defines the position of the mark in terms of territorial, so here are described mark national and international community. The following chapter describes the different types of marks, as amended by Act No. 441/2003 Coll., A trademark, ie verbal, visual and spatial signs and colors as trademarks. The fourth chapter devotes attention to non – traditional trade marks, which are now often recordet in the register of trade marks. The following chapter describes the essential process of the mark in the Czech republic. The last substantive chapter of this thesis defines the charges mark the Czech Republic and the Comunity trade mark. The result of this work is a collection of useful information for both public and private company. This thesis also describe the current phenomenon marks where the customers are entitled under the marks decide what type of product you choose. This statement implies that the marks are not just institutions protect the rights of industrial property, but are historically ingrained and indispensable to human perception.
