Legal relationship between Czech lands and Holy Roman Empire in the Era of Přemyslids with special regard to the succes

Abstract:

Práce si klade za cíl zmapovat právní rámec koexistence mezi středověkou říši Otonů a Sálců a přemyslovskými zeměmi v rozmezí od „temného“ 10. století do „renesančního“ 12. století, které se v právních dějinách v mnoha ohledech jeví jako přelomové. Na vztahy mezi oběma sousedními zeměmi, jejich obyvateli a panovníky se hledí z perspektivy říšských zpravodajů, z nichž jsou bližšímu zkoumání podrobeni ti, jejichž díla jsou v badatelské obci pokládána za „kanonická“, protože skýtají základní orientační body pro poznání vybrané otonsko-sálské epochy. Ve snaze o zajištění plurality žánrů a různorodé místní provenience byla pramenná báze sestavena ze tří kronik a dvou letopisů sepsaných v Porýní, Sasku, Hesensku či Bavorsku. Mezi tvůrci najdeme příslušníky klášterního a světského kléru, mnicha Widukinda z Corvey, biskupa Thietmara z Merseburgu, mnicha a později opata Lamperta z Hersfeldu, potažmo členy benediktinských opatství Sv. Mořice v Niederalteichu a Sv. Michaela v Hildesheimu, jejichž dějepisná produkce zůstává skryta v anonymitě. „Nové čtení“ pramenů má prokázat, že česko-říšský prostor nebyl ovládán pouhým fyzickým násilím a politickým kalkulem, jak hlásala právní historiografie po roce 1945, ale podléhal všeobecně přijímaným regulativům, jež vtiskovaly právní mantinely přeshraničním stykům na nejvyšší úrovni. Aby nadnesená hypotéza nevisela „ve vzduchu“, jsou na její podporu uvedeny a argumentačně rozvedeny dvě hlavní teze. Zaprvé, že politické elity z Čech a říše se ve středověku sdružovaly v rituální společenství (Ritualgemeinschaft), jehož celistvost byla uchovávána opakovaně inscenovanými „právními“ rituály. Uplatnění tu nacházely rituální praktiky darovací, inaugurační a usmiřovací, které jednak navazovaly a prohlubovaly osobní pouta mezi držiteli římského a přemyslovského stolce, jednak v krizových momentech bránily personální svazky mezi korunovanými hlavami (Personenverbände) před rozpadem. Zadruhé, že české země byly na německém dvoře vnímány jako někdy více, jindy méně samostatná zájmová sféra říše, takže panovníci z rodu Otonů a Sálců si osobovali právo zasahovat do vnitročeských záležitostí. Na druhou stranu vládnoucí Přemyslovci byli od 10. století vcelku pokládáni za říšská knížata s právy a povinnostmi z toho plynoucími, třebaže trvalo povědomí o jejich specifickém postavení.

Abstract:

The aim of this dissertation is to delineate the legal framework for the co-existence of the Přemyslid Dynasty with the Ottonian and Salian dynasties in the Middle Ages from the “dark” 10th century until the 12th-century “renaissance”, which is regarded as a turning point in legal history from many points of view. Relationships among the two neighbouring countries, their inhabitants, and their rulers are investigated from the perspective of narrators residing within the Holy Roman Empire. More detailed analysis is conducted of those narrators whose work is considered to be “canonical” in the scientific community as a result of representing basic orientation points for any research during the Ottonian–Salian period. Our collection of sources is based on three chronicles and two annals written in Rhineland, Saxony, Hesse, and Bavaria in order to obtain a variety of genres and local provenances. The authors discussed are members of the monastic and lay clergy – the monk Widukind of Corvey, Bishop Thietmar of Merseburg, the monk and later Abbot Lampert of Hersfeld, and members of the Benedictine abbeys of St. Moritz in Niederalteich and St. Michael in Hildesheim, whose identity remains anonymous. A suggested “new reading” of those sources shall prove that the relationship between Bohemia and the empire was not governed by pure physical force and political calculation, as has been presented by Czech legal historiography since 1945, but was subject to generally accepted regulations which placed legal restrictions on cross-border relationships at the highest level. The presented thesis is supported and developed by two main subtheses. Firstly, political elites from Bohemia and the empire joined forces in a ritual fellowship (Ritualgemeinschaft) the integrity of which was preserved by repeatedly staged “legal” rituals. Ritual practices of donation, inauguration, and reconciliation were employed to create and strengthen personal ties between holders of the Roman and Přemyslid thrones as well as to defend personal ties between crowned heads (Personenverbände) against centrifugal tendencies. Secondly, the Bohemian lands were regarded as a more-or-less independent sphere of imperial influence at the German court, and so Ottonian and Salian rulers claimed the right to intervene in internal Bohemian affairs. Nevertheless, the ruling Přemyslids despite their specific status had been acknowledged as Princes of the Holy Roman Empire with respective rights and obligations since the 10th century.
