Abstract:

Tato práce se věnuje problematice ochranných známek. Celkově je rozdělena do dvanácti kapitol. V první kapitole popisuji historii ochranných známek ve světě a na našem území. Druhá kapitola vymezuje pojem majitele ochranné známky a jeho práva, vynucování těchto práv a trestních postihů v případě porušení. Kapitola třetí obsahuje zákonnou úpravu, včetně mezinárodních smluv. Čtvrtá kapitola pojednává o nejčastějších druzích ochranných známek, které jsou schopné, nebo naopak neschopné, zápisu dle příslušného zákona o ochranných známkách. Pátá kapitola se věnuje samotnému procesu podání přihlášky, s předchozí rešerší, průběhu přihlašovacího řízení. Platnost, neplatnost, vzdání se a zrušení jsou obsahem kapitoly šesté. Nakládání s právy formou převodu, přechodu, licence a další způsoby jsou zmíněné v sedmé kapitole. Osmá kapitola poskytuje informace ohledně stanovených poplatků spojených s registrací a manipulací s chráněným označením. Devátá kapitola definuje podmínky pro výkon povolání a nabízené služby patentových zástupců. Desátá kapitola je soustředěna na registraci označení ve světě. V předposlední jedenácté kapitole zmiňuji spory v oblasti ochranných známek. V poslední kapitole s číslem dvanáct je vyhodnocení zjištěného povědomí problematiky, graficky znázorněného pro větší přehlednost. Závěr zhodnocuje nabyté poznatky, hodnotí míru obtížnosti registračního procesu, shrnuje důvody pro právní ochranu označení a zhodnocuje povědomí o problematice.

Abstract:

This paper deals with the issue of trademarks. It is divided into twelve chapters altogether. The first chapter, I describe the history of trade marks in the world and in our country. The second chapter defines the concept of a trade mark owner and the rights of a trade mark, the enforcement of these rights and the criminal penalties for their violation. The third chapter contains the statutory regulations, including international agreements. The fourth chapter discusses the most common kinds of trademarks that can or cannot be registered under the relevant trademark law. The fifth chapter deals with the actual application process, with previous research and with the course of the application procedure. The validity, invalidity, surrender and cancellation of trademarks are dealt with in chapter six. Dealing with rights in the form of transfers, assignments, licenses and other methods are mentioned in chapter seven. The eighth chapter provides information on the laid down fees associated with the registration and handling of protected designations. The ninth chapter defines the conditions for the exercise of professions and the services offered by patent attorneys. The tenth chapter is focused on the registration of symbols in the world. In the eleventh, penultimate chapter, I mention trademark disputes. In the twelve and last chapter, there is an evaluation of the found knowledge on the issue, which is graphically illustrated for clarity. The conclusion evaluates the acquired knowledge, assesses the degree of difficulty of the registration process, summarizes the reasons for the legal protection of symbols and evaluates the knowledge on the issue.
