Testators debts within the succession procedure (estate) and other related questions, under the regularization effective before and after the 1st of January 2014
Abstract:
Nedostatečná právní úprava řešení předluženosti majetku zůstavitele způsobuje v praxi mnohé potíže, a to zejména věřitelům zůstavitele i jeho dědicům. Právo by mělo zaručit rozumnou rovnováhu mezi povinností dědiců hradit tyto dluhy a možností uspokojit pohledávky věřitelů zůstavitele a další dluhy zjištěné v rámci řízení o dědictví (pozůstalosti). Abstract:
There´re many difficulties caused by the lack of proper regularization in case of testator´s property overindebtedness. Law should secure reasonable balance between the duty of heirs to pay testator ´s debts and the possibility of testator´s creditors to satisfy their claims and other debts found out during the succession (estate) procedure.
