Abstract:

Cílem této diplomové práce je přiblížit základní pilíře problematiky zaměstnávání cizinců v České republice. Autor se v diplomové práci snaží odkazovat i na platnou právní úpravu. Úvodní kapitola je věnována vymezení základních pojmů, provázejících celou práci a přehled právní úpravy vztahující se k výše uvedené problematice. Nejdůležitější pasáže týkající se zaměstnávání cizinců rozděluje autor do dvou kapitol zabývajících se zaměstnáváním občanů Evropské unie a zaměstnáváním cizinců ze třetích zemí. V diplomové práci nejsou opomenuty ani instituty jakými jsou například zaměstnanecká karta či modrá karta. Další část práce se zabývá sociálním zabezpečením. Přiblíženy jsou například koordinační opatření či bilaterární smlouvy. V závěru práce se autor zabývá vybranými soukromoprávními aspekty, přičemž je zmíněn například výkon nelegální práce a shrnutím dosažených poznatků a zhodnocení naplnění zamýšlených cílů.

Abstract:

The presented thesis aims at describing the fundamental pillars on which the employment of foreign nationals relies in the Czech Republic. Within the framework of his thesis, the author refers to the valid legal regulation. The introductory chapter focuses on the definition of basic concepts applied in the entire thesis and provides an overview of the legislation related to the main topic mentioned above. The author divides the essential passages concerning the employment of foreign nationals into two chapters dealing with the employment of the European Union citizens, and employment of foreign nationals from third countries. The Master's thesis also includes institutes such as employee card or blue card. Another part of the thesis deals with various aspects of social security policy, such as coordination measures or bilateral agreements. In conclusion, the author presents selected private law aspects and mentions, for example, the performance of illegal work, and provides a summary of his existing pieces of knowledge, as well as evaluation of the fulfillment of the intended objectives of the thesis.
