Abstract:
Diplomová práce „Literatura jako pramen práva“ má za cíl identifikovat literaturu jako pramen práva. Základním východiskem je rozdělení právních pramenů ve formálním a materiálním slova smyslu. Cílem je určit pozici krásné, náboženské a právní literatury v poměrně formalizovaném právním řádu ČR, práce se však dotýká dané literatury také jako pramene práva v jiných právních kulturách. The goal of the thesis „Literature as the Source of Law“ is to identify literature as a source of law. The intial prerequisite is diversification of sources of law by formal and material meaning. Primary goal was to define importance of fictional, sacral and legal literature in the formal law of Czech republic.
