Potentials and Limits of Contractual Penalty and Interest on Late Payment in Commercial Relations
Abstract:
Diplomová práce se zabývá možnostmi a mezemi smluvní pokuty a úroků z prodlení v obchodních vztazích (tj. i s nepodnkateli). Práce věnuje porovnání institutů v oblasti jejich funkcí, souběhu, zajištěné povinnosti, druhu odpovědnosti a vztahu k náhradě škody. Jsou hledány meze při stanovení výše sankcí a při výkonu práva u soudu. Samostatná kapitola se věnuje postavení nepodniktale.
Abstract:
The diploma theses deals with potentials and limits of penalty clause and interests on late payment in business relations (e.g. also with non-businesman party). The paper concentrates on comparison of the institutes on the field of functions, confluence, liability and relation to damages.
