Family and its Importance in Roman Law

Abstract:

Práce je rozdělena na dvě části. První část je zaměřena na rod a rodové zřízení římského státu, které díky reformám bylo přeměněno na zřízení založené na majetkovém principu. V této chvíli může již hledat náznaky patriarchální rody. Právě naznačený přechod společnosti od rodového zřízení a vývoj rodiny pomohou čtenáři pochopit, proč vznikla rodina, kde životy jejich členů byly v rukou jedné osoby. Druhá část má poskytnout ucelený pohled na římské manželství, které dávalo vzniknout rodině a tvořilo spolu s náboženstvím základní předpoklady vzniku a zachování rodiny.

Abstract:

This work is divided into two parts. The first part focuses on the clan and its organization in the Roman state, which was transformed through reforms into an establishment based on the principle of property. The signs of patriarchal families can already be seen at this point. The transition of the society from ancestral clans and the development of the family will help the reader understand why the family came about, where the lives of its members were in the hands of a single person. The second part provides a comprehensive view of Roman marriage, which gave rise to the family and formed, together with religion, the basic requirements for developing and preserving the family.
