The EU Common Commercial Policy - with a Focus on the Regulation of Trade between the European Union and Canada (Building a Free Trade Area)

Abstract:

Tato bakalářská práce je zaměřena na vzájemné obchodní vztahy mezi Evropskou unií a Kanadou, zejména na jejich úzkou spolupráci na poli mezinárodního obchodu a společné úsilí, jehož smyslem je vytvoření zóny volného obchodu mezi EU a Kanadou, a tím propojení obou břehů Atlantiku. Cílem práce je zejména zanalyzovat proces geneze Komplexní dohody o hospodářské a obchodní spolupráci mezi Evropskou unií a Kanadou - dohody CETA - a na tomto konkrétním příkladu ověřit teoretická východiska sjednávání mezinárodních obchodních smluv EU, jež jsou zakotvena v primárním právu EU, tedy Smlouvě o Evropské unii a Smlouvě o fungování Evropské unie. Poslední kapitola této práce potom nastiňuje vybrané změny, které Komplexní dohoda o hospodářské a obchodní spolupráci (CETA) přináší, především otázky týkající se utvoření zóny volného obchodu, investic a procesu řešení sporů z investic a institucionálního zabezpečení provádění dohody.

Abstract:

This bachelor thesis is focused on the mutual trade relations between the European Union and Canada, in particular on their joint effort to create a EU-canadian free trade area and to develop their close cooperation in the field of international trade, thus to connect the both Atlantic shores. The aim of this thesis is to analyze the procedure of negotiating and concluding the CETA agreement between the European Union and Canada and to verify the theoretical aspects of the concluding of the EU's external trade agreements based on rules in the primary EU law, namely the Treaty on European Union and the Treaty on the Functioning of the European Union. The last chapter of the thesis focuses specifically on the chosen changes, which are brought by the Comprehensive Economic and Trade Agreement between the European Union and Canada, in particular the provisions on the establishing of a free trade area, the investments and the rules of investor-state disputes settlement.
