A Position of the President - Comparing The Czech Republic and Slovakia

Abstract:

Cílem této bakalářské práce bylo porovnat ústavní postavení prezidentů České republiky a Slovenské republiky. Protože oba státy se od sebe oddělily až v roce 1993 je část práce věnována historii a jejímu vývoji od vzniku Československa v roce 1918 až do současnosti. Druhá část práce se zabývá obdobím po rozdělení Československa v roce 1993 na dvě samostatné republiky s tím, že jsou zde uvedeny pravomoci obou prezidentů. Tyto pravomoci jsou pak dále rozvedeny a porovnávány. Další část je zaměřena na volbu prezidenta, která se výrazně liší v obou státech a je tu popsána jak přímá volba prezidenta, která probíhá od roku 1999 ve Slovenské republice, tak volby prezidenta České republiky, kdy je prezident volen nepřímo. V závěru bychom měli najít souhrn odpovědí nejen ohledně porovnání pravomocí prezidentů, ale i odpověď na otázku, která je často kladena v tisku – co by přinesla přímá volba prezidenta u nás a jak se osvědčila nebo neosvědčila přímá volba ve Slovenské republice.

Abstract:

A comparison between the Czech Republic and Slovak Republic form the point of view on constitutional position of the President is the aim of the bachelor’s theses. First part of the bachelor’s theses is dedicated to the history of common country Czechoslovakia from the beginning in 1918 to the separation in 1993. This common existence of two nations has great influence also in terms of common starting point as regards a constitutional position of the President, but later we are witness of relatively independent development of the both constitutional positions. A second part of the bachelor’s theses is dedicated to the independent existence of both countries with the details comparing presidency authorities. Following part of the bachelor’s theses described the process of presidential election, now with great differences in terms of direct presidential election in Slovak Republic and indirect presidential election in the Czech Republic. A conclusion and discussion is concentrated on the identification of strong and weak sites of direct and indirect presidential election from the point of development of democracy in both countries, using a modification of SWOT analysis method.
