Legal regulation of public accessible databases on the internet

Abstract:

V této práci se pokusím shrnout problematiku právní ochrany databází a zaměřím se na databáze veřejně přístupné přes internet. Nejdříve se pokusím definovat pojem veřejně přístupná databáze, následně poskytnout ucelený přehled o právní úpravě databázové problematiky a to jak v rámci předpisů Evropské unie, tak v rámci českého právního řádu. V neposlední řadě upozorním na možnosti využití dat získaných z veřejně přístupných databází.

Abstract:

My thesis, entitled “Legal regulation of public accessible databases on the internet”, can be divided into four separate parts, each addressing issues dealing with the topic. In the first part of my thesis I define basic concepts used in the field of database law as are: database, classification of databases, and publicity of a database. Second part describes utilization of databases in the EU law. The directive of European parliament and European commission 96/6/ES is probably the first complex database act in EU law. I describe more about the history of the legislation process, structure of the directive and its purpose, creation of law Sui Generis, and evaluation of the directive by EU commission. Regulation of databases in Czech law, its protection by the copyright law, and special law protection of the database creator. In third part I describes some practical examples of those databases: the Land register, the Business register, and some details about privately created databases. The final fourth part describes law regulations concerning data acquired from publicly accessible databases and shows some possible usages.
