Perception of organized crime in adjudications in Czech Republic

Abstract:

Tato práce se zabývá pojmem organizovaného zločinu, jako sociálně vědního fenoménu a jeho konstrukcí v rozsudcích soudů České republiky. Organizovaný zločin představuje velice širokou škálu trestné činnosti a tento pojetí tohoto pojmu je tak silně ovlivněno společenským diskurzem. Tato práce se zaměřuje nicméně na to, jak je tento společenský fenomén pojat z praktického hlediska, které je v tomto případě trestně právním vymezení v rozsudcích justičních orgánů, a tedy jaká je jeho konstrukce v očích právní praxe. Pokud tedy existují určité atributy v sociálně vědním úzu, lze předpokládat, že nalezneme podobné také v konstruktu soudním. V práci jsme se tak zaměřili na rozsudky vydané ve věcech týkajících se hmotně právního vymezení organizovaného zločinu a nalezení charakteristických atributů.

Abstract:

This thesis deals with the concept of organized crime as a social science phenomenon and its construction in the verdicts of the Czech courts. Organized crime represents a very wide range of criminal activities and is strongly influenced by social discourse. This work aims on how this social phenomenon can be conceived from a practical point of view, which in this case is a criminal law definition of judicial authorities, and how is organized crime constructed in the eyes of legal practice. Therefore, if there are certain attributes in social science, we can assume that we´ll also find similarities in the judicial construct. In this work, we focused on judgments in matters concerning the substantive definition of organized crime and the finding of characteristic attributes.
