Abstract:

Bakalářská práce pojednává o průběhu, hospodárnosti a obstrukcích ve správním řízení ve věci dopravních přestupků. Cílem práce je popsat a zanalyzovat celkový průběh správního řízení, jakožto i nejčastější a nejzávažnější dopravní přestupky, jejich trestání a postup obstrukčních praktik ze strany obviněných, potažmo jejich zmocněnců a jejich řešení. Teoretická část se zaměřuje na definice důležitých pojmů jako je správní proces, přestupkové řízení, jednotlivé druhy dopravních přestupků, které se projednávají nejčastěji a jejich trestání. Praktická část seznamuje s konkrétními druhy obstrukčních praktik ve správním řízení, jejich dopad na výkon správního práva a také finanční stránku celého procesu. Hlavní metodikou celé práce je rešerše literatury a kompilace. V závěru jsou shrnuty získané informace a jsou popsány možnosti, které mohou pomoci při postupu správních orgánů bránit se účelovým obstrukcím a s tím spojeným zvýšeným finančním nákladům.

Abstract:

The bachelor's thesis discusses the progress, efficiency and obstructions in administrative proceedings in the matter of traffic violations. The goal of the work is to describe and analyze the overall course of administrative proceedings and the progress of obstructionist practices by the accused, i.e. their agents. The theoretical part focuses on the definitions of important concepts such as the administrative process, individual types of traffic offenses that are discussed most often and their punishment. The practical part introduces specific types of obstruction practices in administrative proceedings as well as the financial side of the entire process. The main methodology of the entire work is literature research. In the conclusion, the information obtained is summarized and options are described that can help in the process of administrative authorities to defend themselves against purposeful obstructions and the associated increased financial costs.
