Abstract:

Cílem této diplomové práce je zanalyzovat právní úpravu manželského majetkového práva v občanském zákoníku č. 89/2012 Sb. Důraz je kladen na veškeré majetkové vztahy realizované před uzavřením manželství, v době uzavření manželství a také po zániku manželství. Zohledněn je i historický vývoj právní úpravy manželského majetkového práva. Těžiště práce je položeno na rozbor společného jmění manželů v současné právní úpravě a možnostem jeho modifikace (smluvní, soudní) oproti úpravě zákonné. Pozornost je také věnována právnímu postavení třetích osob, zejména věřitelů.

Abstract:

The aim of this thesis is to analyze the legal regulation of marital property law in the Civil Code no. 89/2012 Coll. Emphasis is placed on all property relations that occurred before marriage, during marriage and upon termination of marriage. The historical development of legal regulation is also taken into consideration. The focal point is laid on the analysis of marital property in the current legislation and potential modifications (contractual, legal) compared to a statutory framework. Attention is also paid to the legal status of third parties, in particular creditors.
