Abstract:

Policejní orgán a státní zástupce v trestním řízení před a po účinnosti novely trestního řádu č.539/2004 Sb. Tato bakalářská práce popisuje postup policejního orgánu a státního zástupce v trestním řízení před a po účinnosti novely trestního řádu zákonem č.539/2004 Sb. Hlavním důvodem k této novelizaci byl vstup České republiky do Evropské unie dne 1.května 2004. České republice po vstupu vznikla povinnost sladit své právní normy s právními normami Evropské unie. V oblasti mezinárodní justiční a policejní spolupráce bylo tomuto požadavku vyhověno právě novelou trestního řádu zákonem č.539/2004 Sb. Tomuto tématu se věnuje kapitola č.1. Kapitola č.2 se věnuje rozdílu mezi činností policejního orgánu a činností státního zástupce v průběhu trestního řízení a také v právním styku s cizinou. Kapitola č.3 popisuje všechny metody mezinárodní justiční a policejní spolupráce v rámci Evropské unie, včetně nových progresivních metod spolupráce zavedených právě novelou trestního řádu zákonem č.539/2004 Sb. Původní metody této spolupráce byly inovovány a umožňují tak efektivnější mezinárodní justiční a policejní spolupráci mezi členskými státy Evropské unie. Evropským zatýkacím rozkazem se zabývá kapitola č.4. Evropský zatýkací rozkaz je také novým pojmem v českém právním řádu zavedeným novelou zákonem č.539/2004 Sb. Evropský zatýkací rozkaz může být použit v případech, kdy Česká republika žádá o vydání osoby z jiného členského státu Evropské unie a také naopak. Z toho plyne, že hlavní podmínkou pro užití Evropského zatýkacího rozkazu je členství obou států v Evropské unii. Kapitola č.5 se věnuje ostatním formám mezinárodní justiční a policejní spolupráce. První část této kapitoly popisuje způsoby doručování dokumentů a písemností mezi Českou republikou a cizími státy. Druhá část se věnuje organizacím pro mezinárodní justiční a policejní spolupráci v Evropě jako je Evropská justiční síť, Eurojust a Europol. A dále se věnuje spolupráci na základě Schengenské prováděcí úmluvy, Schengenskému informačnímu systémemu a SIRENE. Závěr tvoří kapitolu č.6 a jedná se o zhodnocení přínosu novely trestního řádu zákonem č.539/2004 Sb.

Abstract:

The police and prosecutor in the criminal proceedings before and after the amendment No. 539/2004 CS of Code of criminal procedure This thesis describes work of the police and public prosecutor in the criminal proceedings before and after adoption of the amendment No. 539/2004 CS of Code of criminal procedure. The main reason for this amendment of law was that the Czech Republic became the member state of European Union at the 1st of May 2004. The Czech Republic had to duty to unify Czech Code of criminal procedure with the law orders of European Union. It was happen just by the amendment No. 539/2004 CS of Code of criminal procedure. Chapter 1 describes this main reason. Chapter 2 describes the difference between work and tasks of the police and the public prosecutor in the criminal proceedings in the framework of international cooperation. This chapter also describes the relationships between police and public prosecutor during criminal proceedings. Chapter 3 describes all methods of international cooperation in Europe Union including the new progress methods of international cooperation in European Union such as the collective investigation team or secret investigation procedure. Those new methods were introduced to Czech Code of criminal procedure just by the above mentioned amendment No. 539/2004 CS. The primary method for requesting a person has the new provisions now and it provides better possibility for using them both between member states of Europe Union and between member state of European Union and the third state which are not member of European Union. The European warrant of arrest contains Chapter 4 of my thesis. It is also the new procedure of criminal proceedings in the Czech Republic. This procedure can be used when the Czech Republic requests a person from foreign state or when a foreign state requests a person from Czech Republic. The main condition for using this European warrant of arrest is that both these requesting states have to be the members of European Union. Chapter 5 contains next procedures of justice and police international cooperation and the organizations of this cooperation. First part of Chapter 5 describes the way of delivery of decision or of various documents from the Czech authorities to a foreign state or from foreign state to the Czech Republic. The most important organizations of justice and police international cooperation in European Union are European Judicial Network, European Unions Judicial Cooperation Unit and European Police Office. Then the finally part of Chapter 5 describes The Schengen Agreement (Schengen acquis) and Schengen Information System. The last Chapter 6 of my work contains conclusion of this thesis and evaluates the amendment No. 539/2004 CS of Code of criminal procedure.
