Law and Sport - Legitimacy of Sport Rules

Abstract:

Sport prochází v poslední době mnoha změnami. S rostoucí popularitou sportovců, kteří se stávají celebritami, dochází současně ke komercionalizaci a profesionalizaci sportu. Tyto změny ve sportu sebou přináší i častější interakci s právem, poněvadž se zde začínají řešit právně složité situace a objevují se pojmy jako hráčská smlouva, sportovní úraz, prodej hráče atd. Tato práce pojednává o vztahu práva a sportu. O prolínání právních norem s normami sportovními. Dále jsem provedl rozbor fungování, strukturu, orgány a řády Českého svazu ledního hokeje. V první kapitole jsem provedl rozbor vztahu sportu a práva. Sport je zde definován a jsou zde popsány jeho charakteristické znaky a porovnány funkce sportu a práva. Zde jsem došel k tomu, že se tyto funkce zásadně liší. Další část této kapitoly tvoří rozbor pojmu sportovní právo a srovnal jsem zde názory právních teoretiků na otázku vhodnosti právní regulace sportovních vztahů. Sport v dnešním pojetí a hlavně ten profesionální musí být právem samozřejmě regulován. Vylučuji krajní názory, kterou jsou pro úplnou autonomii sportovního prostředí nebo naopak, které vyžadují striktní a bezpodmínečné působení práva ve sportu. Řešením je taková ingerence práva, která zaručí bezproblémový vývoj sportu při zachování jeho kouzla a náboje. V druhé kapitole jsem se věnoval právní odpovědnosti sportovců se zaměřením na odpovědnost sportovců za sportovní úrazy. Z velmi malého množství judikátů týkajících se odpovědnosti sportovců, které se mi podařilo získat, jsem usoudil, že sportovci zatím neuplatňují svoje nároky na náhradu škody soudní cestou. Velkou roli v tom hraje „obecná nevědomost sportovců“. Sportovci většinou ani nevědí, že by mohli svůj nárok soudně vymáhat a to je základ problému. V poslední kapitole jsem se zabýval právními aspekty ledního hokeje. Popsal jsem strukturu a orgány Českého svazu ledního hokeje, hokejové řády a průběh hokejových přestupů. V části o disciplinárním řízení jsem na příkladu konkrétního hokejového utkání ukázal nedostatky, které při tomto řízení vznikají. V části o hráčských smlouvách jsem popsal obsah typizované hráčské smlouvy, vytkl jednotlivá problematická ustanovení a konstatoval nevyváženost těchto smluv v neprospěch hráče. Poslední část této kapitoly je rozborem institutu odstupného za hráče odcházející do kanadsko-americké NHL. Zde jsem došel k závěru, že částky, které NHL vyplatí Evropským klubům jsou nedostačující a při srovnání s částkami, které inkasují fotbalové kluby jsou téměř směšné.

Abstract:

Sport has been going through a lot of changes lately. With increasing popularity of sportsmen who become celebrities, sports happen to be commercialized and professionalized at the same time. These sport changes bring more frequent interaction with law, because legally complicated situations are being solved and new terms appear, e.g. player contract, sport injury, sale of player etc. This work deals with the relationship of law and sport. With the diffusion of sport rules and legal rules. Functioning, structure, bodies and regulations of Czech ice hockey federation are further analyzed. In the first chapter, an analysis of sport and law relationship is performed. Sport is therein defined, number of its characteristic features are described and the function of sport and law are compared. Hereto I figured that these functions are essentially different. Another part of this chapter comprises an analysis of the term Law of sport and a comparison of jurists opinions on pertinence of sports relations legal regulation. Sport in contemporary conception, especially the professional one, undoubtedly has to be regulated by law. I expel extreme opinions which support total autonomy of sport relationships or vice versa, i.e. requiring strict and unconditional operation of law in sport. Solution may be such an intervention of law, which secures trouble-free evolution of sport preserving its magic and feeling. In the second chapter, I concerned myself with sportsmen legal liability with a view to their sport injury liability. Using a little amount of judicature I managed to obtain, I came to a conclusion that so far sportsmen dont draw claims to damages in courts. This fact is highly influenced by the “general nescience of sportsmen”. In majority, sportsmen dont even know they could recover damages at law, which is a bedrock of this problem. In the last chapter, I dealt with legal aspects of ice hockey. I described the structure and bodies of Czech ice hockey federation, ice hockey regulations and the process of ice hockey trades. In a disciplinary proceedings part, I demonstrated in an example of a particular ice hockey game, what sort of deficiencies rise in these proceedings. In a players contracts part, I described the contents of standardized players contract, pointed out problematical regulations and claimed the imbalance of these contracts detrimental for the player. Last part of this chapter is an analysis of an institute of payoff for a player moving away to NHL. Herein I found that the sums which NHL pays the European clubs are insufficient and nearly ridiculous in comparison to the sums which the soccer clubs get.
