Changes of the creditor and debtor in the legal relationship

Abstract:

Diplomová práce pojednává o problematice obecné části závazkového práva, tedy o změně závazků v osobě věřitele nebo dlužníka. Úvodem je věnována pozornost rozboru stěžejních pojmů, se kterými se poté pracuje a dále se rozvíjejí. Následně dochází k analýze dílčích institutů, kterými jsou zejména postoupení pohledávky, převzetí dluhu nebo přistoupení k dluhu. Pro lepší interpretaci jednotlivých ustanovnení využívá tato práce rovněž soudní judikaturu. Zároveň je tato práce zaměřena na komparaci současné právní úpravy s předešlou právní úpravou. Tyto metody zkoumání se projevují v průběhu celé diplomové práce. Zcela specifickou pozornost diplomová práce věnuje změně v osobě směnečného věřitele, s čímž je spojena i konečná úvaha de lege ferenda.

Abstract:

The thesis deals with the issue of the general part of the obligation law that is the changes of the creditor and debtor in the legal relationship. The introduction pays attention to the analysis of the core concepts, which are then worked on and further developed. Subsequently sub-institutes are analysed, which are in particular the assignment of a claim, the assumption of debt or accession to debt. In order to better interpret the various definitions, this work also uses judicial case-law. At the same time, this work is aimed at comparison of the current legislation with the previous legislation. These methods of examination are manifested throughout the thesis. The thesis pays very specific attention to the change in the person of the promissory note creditor.
