Settlement of claims from the Motor Third Party Liability Insurance and the All Risk Insurance

Abstract:

Tato bakalářská práce na téma Likvidace pojistné události z havarijního pojištění a povinného ručení se zabývá rozdíly v likvidaci pojistných událostí a rozdílnými nároky, které plynou z jednotlivých druhů pojištění. Seznamuje s postupem při likvidaci pojistných událostí, stanovením výše náhrady škody a popisuje některá úskalí s tím spojená. Hledá východisko z nesprávného výkladu zákona o pojištění odpovědnosti z provozu vozidel, občanského zákoníku a s tím spojený nález ústavního soudu. Cílem je popsat rozdíly v nárocích z obou druhů pojištění a popsat možné východisko z problémů pojistitelů v souvislosti s uvedeným nálezem ústavního soudu. Tímto východiskem, by v budoucnu mohla být tzv. „přímá likvidace“.

Abstract:

This thesis on theme Settlement of the insured events from All-risks Insurance and Motor Third Party Liability Insurance deals with differences in the ways of its settlement and the claims, which follow from individual types of insurance. It presents the method for settlement of the insured events, compensation amount´s assessment and describes some difficulties connected with that. This thesis is trying to find a solution to the incorrect law´s reading of Motor Third Party Liability Insurance, Civil Code and the court´s finding related to that. The main target is to describe the differences between both insurances types´ claims and its possible problems´ solution of the insurance companies in connection with the mentioned finding of the court. The solution of this matter could be „Direct Settlement“ in the future.
