Issues of the legislative protection of persons with disabilities in employment

Abstract:

V rigorózní práci autor důkladně analyzoval situaci zaměstnávání osob se zdravotním postižením v České republice. Nejvýznamnější právní předpisy upravující danou materii představují Ústava s Listinou základních práv a svobod, zákoník práce a zákon o zaměstnanosti. Právní úprava zkoumané problematiky je bohužel značně roztříštěna, a tak osoby potřebné seznámit se s problematikou mají značně složitý úkol, navíc, Česká republika je signatářem řady mezinárodních smluv. S ohledem na stále významnější regulaci práva Evropské unie je nutné uvést, že i v této oblasti je vliv unijní regulace stále více zřetelný. Autor v díle podrobuje českou právní úpravu srovnání i se zahraniční právní úpravou, konkrétně dochází ke komparaci právní regulace s Německem a Finskem, přičemž v obou státech je úprava dosti rozdílná. V počátku práce dochází k definování osoby invalidní. Dále se autor věnuje principu odměňování za vykonávanou činnost a srovnává, zda osoby invalidní jsou odměňování stejně jako osoby bez zjevného postižení. Obsahem práce je též analýza, zda je dodržována v pracovněprávních vztazích zásada zákazu diskriminace a rovného zacházení. Osoby zdravotně postižené mají problém při získání zaměstnání, a tak by jim mělo být účinně pomáháno jej získat. Zásadním cílem pro zapojení zdravotně znevýhodněných osob do pracovního procesu by mělo být jejich skutečné zaměstnání, v České republice se jedná o kvótu 4 %, nicméně stát umožňuje i alternativní splnění této povinnosti.

Abstract:

In this advanced master’s thesis the author thoroughly analysed the situation in employment of the persons with disabilities in the Czech Republic. The most important legal regulations dealing with the topic at hand are the Constitution together with the Charter of the Fundamental Rights and Basic Freedoms, Labour Code, and Law on Employment. Legislation in this matter is unfortunately quite fragmentised, therefore persons trying to study the issue have a very complicated task. Even more so due to the Czech Republic being a signatory of a number of international treaties. With ever higher importance of the legislation of the European Union it is important to note that the influence of the EU legislation is quite significant in this field as well. Author in this work also compares the Czech legislation with that of other countries, namely he offers comparison of the regulation with that of Germany and Finland as in both countries are the regulations quite different. At the beginning of the work author defines a person with disabilities. Then the author deals with the principle of the remuneration for the carried out tasks and tries to find out whether the persons with disabilities are remunerated as the persons without any visible defects. Analysis of the question whether the principle of non-discrimination and equal treatment is being followed in the labour-law relations is next. Persons with disabilities are having problems trying to find a job and so they should be efficiently helped to obtain one. Main goal for the inclusion of the health disadvantaged persons in the employment should be their real jobs. In the Czech Republic the quota is set to 4%, the state however offers alternative way to meet this obligation.
