Current Legal Regulations of Nullity Plea as an Extraordinary Legal Remedy and its Relation to Legal Regulations of other Extraordinary Legal Remedies in Civil Trial.

Abstract:

S účinností od 1. 1. 2001 byla do českého právního řádu po padesáti letech znovu zavedena žaloba pro zmatečnost. Cílem této práce je pokusit se vystihnout smysl a význam tohoto staronového právního institutu. Pro bližší identifikaci žaloby pro zmatečnost je nezbytné její posuzování nejen z hlediska pozitivního usazení v okolním světě právních norem, ale i z hlediska jejich materiální existence ve společnosti jako celku. Každý institut je třeba posuzovat jednak z hlediska jeho vlastní podstaty, ale také v souhře a srovnání s ostatními instituty. Proto je práce také strukturována tak, aby se žalobě pro zmatečnost dostalo jednak detailního pohledu zevnitř, ale také aby bylo zmíněno její poslání navenek.V první kapitole je věnována pozornost takříkajíc životnímu prostředí žaloby pro zmatečnost. Tím je jednak právní prostředí, a to v podobě pozitivního zakotvení základních institutů fungování státu a práva vůbec, ale také jejich existence v reálném světě. Právní řád, pokud nemá být pouze nepřehlednou směsicí článků a paragrafů, musí mít nějakou hierarchii, na jejímž vrcholu stojí ty nezákladnější principy, které definují ten který právní systém. Proto je poměrně významně v práci zmiňován vztah žaloby k základním předpisům, které nejvíce vypovídají o tom, k jakému že to účelu tu vlastně je. Od nich se potom práce odráží ke stručnému pokusu o vystižení významu civilního procesu, jehož pochopení je pro porozumění žalobě pro zmatečnost nezbytností. V kapitole druhé už je znát přiblížení k samé podstatě práce. Tato část pojednává o významu možností nápravy soudních rozhodnutí, jakožto samé podstaty a cíle civilního procesu. Co se týče výletu do minulosti za původem tohoto procesního institutu, ten je obsahem kapitoly třetí. Počátek historické anabáze začíná v době, kdy právní institut žaloby pro zmatečnost vešel poprvé na našem území v život, i když by samozřejmě bylo možné stanovit tento počátek jinak. Vůdčí snahou zde bylo sledovat, jak a v jakých institutech bylo možno uplatňovat závažné vady v postupu soudů v dobách a předpisech minulých, s přihlédnutím k historickopolitickým okolnostem.Současná právní úprava tvoří jádro celé práce a je soustředěna do kapitoly čtvrté. Pro větší přehlednost je, tam kde je to trochu možné a účelné, při výkladu zachována systematika zákona. Pod drobnohled jsou postaveny zejména důvody žaloby pro zmatečnost, které tvoří páteř celé právní úpravy tohoto institutu, a také páteř této práce. Pro jejich správné pochopení a interpretaci je mnohdy nutné přiblížit i právní úpravu souvisejících institutů, někde více, někde méně podrobně, je to však nezbytné s ohledem na snahu o ucelený pohled. Protože žaloba pro zmatečnost, jako mimořádný opravný prostředek není v českém právním řádu osamocena, je v kapitole páté věnována pozornost jejímu vztahu k dalším prostředkům této skupiny, tedy žalobě na obnovu řízení a dovolání.Konstatování nedostatků či nepřesností, úvahy o možných změnách de lege ferenda jsou povětšinou rozptýleny v textu práce tam, kde je o dané problematice pojednáváno. V kapitole šesté pak najdeme stručné shrnutí těchto myšlenek, ale také některé úvahy, které bylo těžké systematicky zařadit do té které kapitoly či podkapitoly. Obsahuje také závěrečné slovo, které je spíše jakýmsi vyjádřením přání.

Abstract:

Czech Republic set out on the road to democracy and the rule of law, after he revolution in November 1989 and started to create a new, democratic state. The principles of modern democratic state are formally stated in the Constitution of Czech Republic and in the Charter of Fundamental Rights and Freedoms. The important parts of these rights are judicial rights, which include: right to fair trial, legality of criminal law, proscription of retroactivity, independence and impartialness of the court, right to a legal judge etc. Czech Republic is not bound to serve these fundamental rights not only because of Czech constitutional law, but also out of the reason of liability by international law. Also becoming a rightful member of European Union and NATO, that was the culmination of the processes after 1989, bound the Czech Republic to keep these rights and give help to all countries, where the fundamental rights are breaking. Interest of the society on the most rightful judgement as possible is the purpose of these rights. We can never cut out the possibility, that the judgement is not fair, because all the judges are only people. That is why; the law gives the possibility to change that judgement to the parties. Those instruments are called discretionary remedies. We can divide them in dependence on the fact, if the judgement is legitimate or not. If the judgement is not even legitimate, it is possible to change it by means of ordinary remedy appeal to a court. If the judgement is legitimate, the chance to cancel it, is little bit complicated, but it is also possible. The extraordinary remedies in Czech procedural civil law:1. Extraordinary appeal it is allowed, when the party claims, that the case was ill-judged in former trial. 2.Retrial it is allowed, when there are new evidence or new matters, which were not known in former trials. 3.Nullity plea it is allowed, when there were great procedural mistakes in the former trials. Nullity plea was reimposed to Czech civil trial after fifty years by the code No 30/2000 Coll., which was one of the most important amendment of Czech procedural law. The civil procedural law gives conditions, which should be satisfied, so that the trial could start or proceed. If they are not, the court must stop the trial. These essential conditions are so important, that the court must annul the judgement, independently on the fact, that the mistake of the court was the reason for giving the ruling. Now we can find nullity plea in Act No 99/1963 Coll., in the articles 229-235i. Although this juridical institute of Czech civil law is quite new, the reasons of nullity was the reasons of extraordinary appeal and retrial before 2001. The reason, why the nullity plea was reintroduced to our legal system, was that the majority of these cases were heard by the Supreme Court of Czech Republic, which has a little bit different function. The function of Supreme Court was also newly formed, and from the force of legislation act No 30/2000 Call., is the function o supreme court (together with making decision in the cases of extraordinary remedies) is to associate decision-making activity of lower courts. Because the nullity plea is quite new juridical institute, there are not so many practices of the courts. Together with the fact, that it is not the most frequent institute, it is very difficult to assess the importance of reintroducing nullity plea. The very necessary thing, that is also the duty for the legislators, is the new codification of civil procedural law, because current code is very out-dated. The complicacy of procedural rules should not be the reason, why one cannot enforce his rights. The law is only the instrument in the hands of judges, and it is their responsibility to use it on behalf of equity.
