Judicial co-creating the Law

Abstract:

Závěrečná práce analyzuje soudcovským dotvářením práva. Na začátku nastiňuje pojem práva a pojednává o pramenech práva, kde se především věnuje právním předpisům. Druhá kapitola se zabývá problematikou mezer v právu a jejich rozdělením. Kapitola následující rozebírá aplikaci práva a to hlavně skrz subsumpci a sylogismus. Podstatná část práce se snaží přiblížit metodologii interpretace práva s hlavním zaměřením na teleologický výklad, a to i z hlediska judikatury Ústavního soudu. Na závěr uvádí konkrétní interpretační postupy při dotváření práva a řeší soudcovskou svévoli.

Abstract:

The diploma thesis analyses judicial co-creating the law. At the beginning it deals with concept of law and it addresses sources of law, mainly the thesis focuses on the legal rules. The second chapter deals with problems of gaps in law and it is also about classification of gaps in law. The following chapter addresses the application of the law, mainly through subsumption a syllogism. The cornerstone of the diploma thesis describes interpretation of the law where it focuses on teleological interpretation and the jurisprudence of the Constitutional Court. The last chapter is devoted the specific methods of interpretation in judicial co-creating the law and it deals with the judicial arbitrariness.
